State Supreme Court Denies - Signing of Contract Exempts One.

Teachers who have served five or more years come under provision of the Teachers’ Tenure Act regardless of the type of contract they have signed, the Indiana Supreme Court held today. The Supreme Court asserted that the fundamental purpose of the law “is to protect the educational interests of the State by the establishment of a ‘uniform system of permanent contracts.” Specifically the opinion upheld the right of Lafayette School Board to discharge Albert E. Highley as superintendent on July 15, 1932. Mr. Highley, who was first employed as superintendent in 1923, was discharged by the School Board under the procedure established by the tenure statute. He claimed he did not come under this act because he had signed a new five-year conJat with the Board on Aug. 1, In reversing the Montgomery County ' Circuit Court decision which sustained Mr. Highley’s position, the State Supreme Court said: “It is not the purpose of the tenure act to foster the interests of "or ‘to create a special privilege to any teacher or class of teachers. The policy of the law is to establish a uniform tenure system for all of the schools in the State. “If a teacher is to be permitted to make his choice as to whether he shall claim a right to hold his position either by virtue of a special written contract or by virtue of being a permanent teacherynder an indefinite contract, the entire school system of the State will become unsettled.”

SON OF AURORA MAN IS DEAD AT SEVILLE

AURORA, Feb. 16 (U. P.).—Word was received .here today of the sud«den death at Seville, Spain, of Jerry Backman, 41, son of Mr. and Mrs. John J. Backman ef Aurora, who for the last eight years has been general manager and secretarytreasurer of the Spanish Armstrong Cork Co. The telegram received today oy his parents from the Lancasfer, Pa., office of the company did not reveal

' the cause of death.

Mr. Backman visited here last summer on a brief trip from Spain. He told friends at that time he was sympathetic to the cause of the insurgents led by General Franco. - He had attended Purdue University and saw service in France with the American Army.
