HIGH COURT TEST ANTICIPATED ON DRUNK-O-METER

Its Evidence Disputed by Mrs. Davis’ Counsel in New Trial Plea.

Possibility of a Supreme Court ruling on the admissability of “drunk-o-meter” tests as evidence in drunken driving cases was indicated today in the filing of a new trial motion in Criminal Court.

A new trial was asked by Clyde P. Miller, attorney, in behalf of Mrs. Florence Simmons Davis, convicted recently on a manslaughter charge in the traffic death of a 14-months-old child. The request for a new trial was based solely upon the contention that admission of the drunk-o-meter evidence was an error.

Ruling Expected Today

. ‘Circuit Judge James A. Emmert, Shelbyville, special judge in the case, is expected to rule on the motion today. Judge Emmert admitted the “drunk-o-meter” test evidence. Criminal Court Judge Frank P. Baker, shortly before the motion was filed in Mrs. Davis’ case, advocated wider use of the drunk-o-meter. He said he believed evidence obtained from the device would be more accurate than testimony of witnesses in many cases.

BAR UNIT DISCUSSES _ CONSTITUTION FETE

State’s Part in Celebration To Be Mapped Today.

Plans for U. S. Constitution Sesquicentennial celebrations in a majority of Indiana communities were to be outlined today at a luncheon meeting of the Indiana State Bar Association's American Citizenship Committee at the Claypool Hotel. Franklin County Circuit Court Judge Roscoe C. O'Byrne, Brookville, committee chairman, and Oscar A. Ahlgren, Whiting, and Robert R. Batton, Marion, members, are to explain the committee's work in enlisting local celebration leaders. In appointing an official Indiana Commission to have charge of the State's participation in the observance, Governor Townsend selected the three members of the Bar Association’s committee, and Floyd I. McMurray, State Superintendent of Public Instruction. Louden L. Bomberger, Indiana State Bar. Association president, Harold H. Bredell, Indianapolis, Junior Bar Conference Indiana chairman, and committee members are to speak following today’s luncheon.

Brinkworth, Aluminum Co. of America sales representative here. He detailed the new uses to which aluminum has been put in recent years. He cited its use in aircraft, buildings and railroad rolling stock after early limitation to the cooking utensil industry.

LAFAYETTE, Feb. ¢ (U. P).— Second semester registration at Purdue University is expected to total 5900, school officials said today. A total of 6176 registered for the first semester.

BENEFIT IS PLANNED FOR FLOWER MISSION

The Alpha Kappa Latreian Club is planning a benefit card party for the Flower Mission Hospital at L. S. Ayres & Co, March 15, by Mrs. James D. Ermston, hospital committee chairman, announced today. Mrs. Fred Noerr, Flower Mission visitor, told directors yesterday there was an increased demand for milk and clothing for tubercular children.

LECTURES ON CONSTITUTION Charles H. Money, Washington High School social science department head, will speak on the “Pundamental Law, or The Flexibility of Our Constitution” at the third of the Town Meeting Talks. at the school Feb. 15.
