STORE ROBBED: WOMAN ROUTS HOME PROWLER

Thieves Rip Bars Off Window Of Building to Get Clothing Loot.

Police today sought burglars who ransacked a department store and another who fled from an Bast Side home. Three men and two women were held as suspects in several other robberies. Henry Rothschild, who operates a store at 5056 W. Washington St., told police that a large quantity of clothing was stolen during the night and that hie was taking an inventory to determine the loss. He said the burglars ripped bars off a rear window. Police sought a tall youth who

fled the home of Mrs. Edna Trees, of 3820 E. New York St., late yesterday when she surprised him ransacking her bedroom.

Mrs. Trees reported she returned to her bedroom after fixing the furnace when she saw the burglar. He demanded her money. Calling for help, she ran out the front door. The burglar escaped through the rear door. The five suspects were arrested

Following the man from a downtown hotel, Mr. Heard called an officer. Records disclosed the man was an ex-convict. Circulars from Louisville revealed he was suspected in severa] safe burglaries. Detectives raided an apartment in the 100 block Park Ave. and arrested two women. Checking an address found in the man’s possession, detectives raided another apartment where they arrested two other men.

‘Adequate’ Grounds Clause Expected to Answer Attack on Board.

WASHINGTON, Feb. 2.-=The Wagner Labor Relations Act has just been “defined” by the Supreme Court in a way which meets one of the major attacks on the law. Lawyers said today the court's decision Monday in the Bethlehem Shipbuilding Case, unanimously rejecting an injunction attack on the Natioal Labor Relations Board, definitely states for the first time that evidence supporting a ‘decision

by the Board must be “adequute.” Also that the Circuit Court of Appeals is the judge of such adequacy. The law itself simply says that the Board's findings of fact shall be final “if supported by evidence.” Senator Burke (D. Neb.) has demanded revision of the act to require that findings be supported by “the weight of the evidence.” Associate Justice Louis J. Brandeis’ opinion in the Bethlehem Shipbuilding Case states, in explaining the Board's procedure, that Circuit Court of Appeals will refuse to enforce board decisions if “it concludes that such findings were without adequate evidence to support it, or otherwise contrary to law.” The ruling is reminiscent of the Supreme Court's famous Standard Oil decision of 1911, which held that

the Sherman Antitrust Act was enforceable only against “unreasonable” restraint of trade. The law itself forbade ‘restraint of trade” and didn't mention “unreasonable.” Lawyers believe the Court would have had to hold the entire Sherman act invalid if it had not “written in” the word “unreasonable.” Labor Board lawyers say they are

not alarmed by the requirement of “adequate” ‘evidence. They say their long and exhaustive hearings have been aimed at bringing forth such proof.
