KIDNEY Times Staff Writer WASHINGTON, Dec. 30.—Senator VanNuys was a delegate to the Democratic national convention in 1924 and voted dpproval of the platform indorsing a referendum on war. Today he still is in sympathy with the idea, he said, when the united peace organizations pointed out that thé Democratic Administration has deserted the 1924 party policy by opposing Ludlow’s amendment. ? “I have given sympathetic support to Rep. Louis Ludlow’s war referendum plan,” Senator VanNuys said. “It is a proposal well worth serious consideration.” Senator VanNuys said his mail contains many more letters supporting the Ludlow amendment than opposing it. They come particu~ lary from peace organizations and women, he said.

Answers Opposition

- For several years, Mr. Ludlow has been seeking passage of his prowhich would amend the Constitution so that a referendum would be held on United States participation in any foreign war. It is scheduled for action in the House Jan. 10, having been forced from committee by a discharge petition with 218 signers. Answering the opposition of President Roosevelt, Secretary of State Hull, Senator Pittman, Senafe Foreign Relations Committee chairman, and other Administration leaders, the peace organizations charged today that ‘these same people were responsible for the 1924 platform plank. : The 1924 Democratic ~ platform ‘indorsed the war referendum plan “except in case of actual or threatened attack” on the ground that: “Those who must furnish the plood and bear the burdens imposed by war should, whenever possible, be consulted before this supreme sacrifice Is required of them.”

This section was unanimously adopted. : Secretary Hull was ehairman of the Democratic National Committee in 1924; Attorney General Cum- _ mings was chairman of the platform committee and Senator Pittman secretary of the platform committee. Delegates voting approval included President Roosevelt, Vice President Garner, Secretary of Navy Swanson, Postmaster General Farley, Secretary of Commerce Roper; Louis A. Johnson, Assistant Secretary of War; Chairman Jesse H. Jones of the Reconstruction Finance Corp, and W. A. Julian, Treasurer of the United States. The latter still is for the plan and has written Mr. Ludlow his indorsement of it. 4 % 7% Numerous Democrats now in the House or Sénate also are listed as delegates to that convention. All these so-called “peace groups” are united in an effort to secure a favorable vote on the Ludlow plan. The measure must pass both houses of Congress by a two-thirds vote and then be ratified by threefourths of the states. :

State Defends Weight Levy Act; Seeks to Block First Test.

Deputy Attorney General Joseph W. Hutchison today defended the State's new truck weight law enacted by the 1937 Legislature as a hearing opened before Superior Court Judge Joseph Markey on the State’s demurrer to the test suit filed by a group of truckers. Meanwhile, a second suit attacking the validity of the act was filed in Superior Court by Kenneth Foster, Indianapolis truck line operator, contending that the law violates a contract between State and Federal Governments, The plaintiff claimed that the Federal Government .contributed millions to construction of Indiana roads with the provision that the State use motor vehicle’ taxes to build and maintain public highways. He alleged that the State is diverting $1,250,000 annually into the

Shell Petroleum Seeks SixMile Right-of-Way.

County Commissioners today considered granting a franchise to the Shell Petroleum Corp. to lay a sixmile pipe line through the northern part of the county. The joil company, according to its representative, wanted the franchise to complete a pipe line from Wood River, Il, to Lima, O. The company has asked for a 25-year franchise. Jan. 14 was set as date for final consideration by the Commissioners. :
