ICC SPEEDS UP RAIL RATE CASE|
Spurred by F. D. R. Plea for Early Ruling, Bureau ‘Advances Hearing.
WASHINGTON, Dec. 11.. (U. P.), —The Interstate Commerce Com‘mission, pressed - "President Roosevelt for “early determination” of the railroads’ plea for $517, 000,000 per year more revenue, today advanced the case nearly a month by revising its schedule of hearings.
The ICC first set the final hear-
ing for Feb. 7. Today it issued a new schedule -of hearings, moving up the final date to Jan. 17. Yesterday the ICC turned down the railroads’ motion for an immediate authority to advance freight rates 15 per cent on five days’

of their application for a permanent. 15 per cent rate increase. Today’s decision by the ICC to speed the railroads’ case even faster indicated that a final decision might come before Feb. 20. The President said yesterday that the railroads’ financial problem was one for the ICC and that the soon-| er a decision was reached the better. As another means of expediting the case, the Commission specified that any briefs or memoranda should be served and filed by the time oral argument is ended. Argument will begin immediately after all evidence: is in, it was ordered.

P.)—o Methodist - officials today set up a five-month program of church activity participated in by United States; Canadian and English leaders to celebrate the 200th anniversary of the “conversion” of John Wesley, who founded their church. | Highlighting the celebration will be a “United Methodist Council,” drawing 4000 church leaders to Chicago on Feb. 3, 4 and 5, and the fingl vote next May, by the general conference of the Methodist Episcopsl Church, South, on church unifice.tion which already has been ratified by the other major divisions. An attack on President Roosevelys “campaign to curb the power of the Supreme Court” was made by Arcliie N. Bobbitt, Republican State Chairman, at the dedication of the Wasiington Township Republican Club, 6234 Bellefontaine St., last night. “Following his failure to pack the Court,” Mr. Bobbitt charged, President began a drive to curb the power of the fribunal to pass bn constitutionality of acts of Congress. “It is apparent, by the very nature of our Government, that the question of whether a statute is in con= flict with the Constitution must, of necessity, be. determined by the courts.”

a special judge. The petition asks that the Supreme Court suggest three judges. The trial originally had been set for next Wednesday before Criminal Court Judge Frank P. Baker.
A venire of 125 names had been drawn and summons issued. Court attaches indicated the entire venire may have to be redrawn. Charles MenMuir, 74, of 676 E. Fall Creek Blvd. died in City Hospital early today from injuries received when struck by an automobile at Massachusetts Ave. and St. Clair St. Monday. His death also raised the City’s traffic deaths to 97 for the year, Driver Not Held Mrs. Rose Basey, 25, of 2037 Ludlow Ave., driver of the auto, was not held. Mr. MenMutr, who came here from Connersville five years ago, was an employee of the Business Furniture Co. He was a member of Broadway Methodist Church and the Masonic Lodge. Survivors are the wife, Mrs. Luetta MenMuir; daughter, Mrs. C. S. Ober, Indianapolis, and sister, Mrs. Mattie Smyth, Colville, Wash. .- Funeral services are to be held at 3:30 p. m. tomorrow in Flanner & Buchanan Mortuary. Burial will be in Oxford, O.
Rearrest Ordered
Rearrest of Roy McDonald, 28, truck driver who is alleged, to have struck a School 14 pupil and endangered others Thursday, was ordered when he failed to appear in Municipal Court today to answer charges of reckless driving, failing to give a hand signal, failing to give right of way to a pedestrian and violating a traffic signal. Judge Pro Tem. Jacob Steinmetz set bond at $500, but police were unable to locate the defendant. McDonald was arrested yesterday and released on his recognizance. Affidavits against McDonald were signed by Gene Roberts, 13, of 541 Dorman St., a School 14 schoolboy patrol officer. Edward Dummick, 7, of 421 N. Walcott St., was struck by the truck, police said, but was uninjured.
