Judge ‘Proposes Conditional Divorces for Children’s Sake

Fewer children would be raised

in broken homes if judges were em-

powered to withhold divorce decrees after evidence is heard and attempt to reunite the parents, Superior Judge Clarence E. Weir declared today.

Judge Weir suggested amending

laws to give judges more discretionary power in this respect as an alternative to establishment of a separate domestic relations court. A recent survey showed six of seven judges questioned favored a domestic relations court in the county. The plan suggested by Judge Weir included establishment of a staff of special divorce court investigators whose duty it would be tc investigate causes for estrangement and attempt to affect reconciliation. According to Judge Weir, work of investigators would follow trial of the divorce case. He said only after facts are heara can a judge determine whether there is possibility for reconciliation. Possible reconciliation was the basis for enactment of Indiana’s 60day divorce filing law, Judge Weir said, but little ever is done before the case comes to trial. Judge Weir cited divorce proced-

ure in England as an example of divorce court procedure. “In England, a judge may hand down a conditional divorce degree which ‘would be final at the discretion of the court and depend upon subsequent circumstances,” he said. “I am thinking principally of the

hardships to children that result from divorce.” Judge Weir added. “I have said before that children, most affected by divorces, receive least consideration.”
