COURT ORDERS | RE-ARREST OF | DR. E. S. GARR
Bond Forfeited on Failure of Suspect to Appear at | Arraignment. |
SHELBYVILLE, Ky. Oct. 8 v.| ’ P)—Dr. E. S. Garr, veterinarian | who admitted participating with | his two brothers in assassination of '
Brig. Gen. Henry H. Denhardt, was | sought for re-arrest today for fail-
ure to appear at arraignment. Circuit Judge Charles C. Marshall | ordered Dr. Garr’s $20,000 bond for- | feited. Defense counsel, however, Jd
presented an affidavit from Dr. H. | B. Blaydes, LaGrange, which said Dr. Garr is a “person of unsound mind, under the influence of opiates at his home near LaGrange, unsafe and dangerous for his health and for the public for him to be
brought into court at this time.” 9 Defense attorneys said they would | file a response to the forfeiture | ) order later, with a request to have |
it set aside. | Because of Dr. Garmr's absence, | § Judge Marshall refused to consider
a motion that his trial be continued | until the next term of court. He . ordered trial beginning Oct. 18 of | the blanket indictment which ac-
cuses Dr. Garr and brothers, Jack and Roy, of first-degree murder. The $10,000 bond of Jack Garr and $20.000 bond of Roy Garr was renewed bv six bondsmen, and Roy said. “Thank God, we don't have | to go back to jail.” | The Garrs surrendered to police |
immediately after Gen. Denhardt | was slain. Roy and the doctor said | thev did the shooting but in self-
defense when they thought Gen. Denhardt reached for a gun. Jack ; said he fired no shots. Judge Marshall, during his study of records vesterday, said: “There is nothing in the record to show that Jack Garr committed any crime.” Gen. Denhardt was slain on the
eve of his second trial on a charge of murdering Mrs. Verna Garr Taylor. his fiancee and the Garr brothers’ sister.

of 1omas Casey and Andy Donlan, charged with operating a gaming house, was to be heard in Municipal Court today. | Clyde Carter, judge pro tem, | postponed proceedings yesterday after the defense had shown with protographs made by police that search warrants on which the raid
was made were faulty. Police took the photographs when they raided an alleged "bookmaking shop” at 134 8. Illinois St., Sept. 25, Affidavit Is Quashed ! & \ David Lewis, defense attorney, moved that the affidavit which search warrants were obtained be quashed after pointing out that the photographs showed more than the For Men one room in the place designated in and the warrants as the ‘rear room.” l Young Men Judge Carter sustained the mo- :
tion. The prosecution, however proceeded to try Dolan and Casey on evidence obtained by police previous
to Sept. 25.
Judge Carter said cases of 67 others, charged with visiting a gaming house, would be disposed of after the Donlan-Casey case is completed.
