Committee to Insist That Spurned Amendments Are Worthy.

City Combustion Engineer J. W. ‘Clinehens said today that the Mayor’s / Advisory Committee on ‘Smoke Abatement will reintroduce to the City Council amendments to the present smoke ordinance. The Council . defeated the pro.posed amendments Monday night. “They were reported ufavorably to ‘the Council by the Law and Judi‘ciary Committee, of which William Oren is chairman. Mr. Oren said: “The amendments were not need.ed. We already have enough regulations on smoke to take care of it. ‘The standards of density set up by ‘the amendments would require a ‘density so thin that nobody could ‘conform to them and remain in town.” In reply, Mr. Clinehens today de.clared:

Code Book Is Cited

He opened the code book and ‘pointed to a passage which, in effect, ‘said that any smoke would be con‘sidered a violation of the ordinance if light equal to the power of 16 candles could not be seen through it. This, he said, was the same in fhe amendments submitted to the Coun‘cil, because no section of the ordinance can be changed without repeating the entire section. He showed where the change had been made, in a provision giving the Smoke Abatement Department permission to use the Ringelmann chart in observing smoke densities. The amendment was. part of the section setting out the standards for smoke ‘densities. ' Considerable confusion resulted in the Department after the Council ‘killed the measure with the single explanation, “We have enough regulations already.”

Other Revisions Mentioned

Mr. Clinehens pointed out other revisions in the ordihance which the amendments called for. One would allow prosecution of firms with “processing furnaces” that establish themselves in the city in the future. All now established are exempt. Thus, he said, the city could specify to firms coming here where they should be located or what type of equipment they should use. He said one company’s smoke now is a hazard to the Methodist Hospital. Another amendment prohibites locomotives from creating smoke “more than one consecutive minute” while in motion, and for more than 10 minutes while remaining stationary

: “Smokeless Fuel” Defined

The last was a clause defining “smokeless fuel.” Mr. Oren today said that nobody had explained the proposed changes to the Council and’ it knew “nothing about the provisions regarding locomotives.” Mr. Clinehens said the work in the Department would not suffer as a result, and that it sought permission to use the Ringelmann chart “only to bring the department up to the standards in other cities.” © He explained that with it, they ‘could plot smoke observations in their varing degrees over a period ‘of time, whereas the umbrascope ‘now used spotted only violations. The amendments were the first drawn up by the Mayor's Advisory ‘Committee appointed by former Mayor Kern last April. Mr. Cline‘hens is a member of the Committee.
