WHEREAS, the City of Indianapolis, Indiana. a municipal corporation, is engaged through its Board of Directors for Utilities of its Department of Utilities under the name of Citizens Gas and Coke Uiility in the manufacture, distribution and saie of gas and desires to extend its gas main | pipe lines into the corporate limits of | the Town of Lynhurst, Indiana, vbrovided it receives permission from said town permitting it to lay and maintain its pipes and mains upon and through the highways and public grounds of said town in oresr to sell to inhabitants therest, Ras pr duce, distributed or sold by it: an WHEREAS: said Town of A is willing to grant such permission upon certain terms and conditions herein expressed. NOW. THEREFORE, BE IT ORDAINED BY THE TRUSTEES OF THE TOWN OF LYNHURST, that the said town of Lynhurst, in consideration of the several agreements of the said Board of Directors for Utilities hereinafter contained, does hereby grant, authorize, empower and ermit said City of Indianapolis, Indiana, its successors and assigns, to enter upon the streets, alleys. avenues and other public places and parks of the said town and to excavate and construct the necessary ditches, trenches, conduits and tunnels, and to place, lay. bury, maintain, extend, repair, remove and operate, and to transmit and supply gas thereby, a system ‘of ipes therein of such size, nature and De as the said City of Indianapolis, Indiana may require for the distribution and sale of gas to said town and inhabitants thereof for fuel and heating and lighting purposes. together with the right to construct, maintain, remove, operate and repair all necessary regulators, valves. curb. boxes, and other appliances and appurtenances, Subject to the following conditions, to wit

1. All work done in or upon any of the streets, alleys, or Reon places in the said town, either in the original construction or in making repairs, all be done, and all trenches shall be a and pipe laid and the trenches or ditches closed within the shortest possible time within which the same can be done with skillfulness and dispatch after work has been once commenced. 1 work shall be done so as to interfere as little as possible with public use and travel upon said streets, alleys and public ground. and the said Board of Directors for Utilities shall’ cause the streets and other places to be restored to the condition in which they were just prior to the commencement of such work, and shall cause the streets i. other places affected by such work to b cleared of aT and rubbish resulting from such

Service pipes from the gas mains to property lines shall be put in at the expense of said Citizens Gas and Coke Utility, and the continuation of such service pipes, from the property lines to the location fof the consumers’ meters shall be laid under. the direction of said Board cf Directors for Utilities and the expense thereof shall be paid for by the owner or the occupant of the premises to be connected under the regular published schedule of charges of said Citizens Gas and Coke utility for the installation of similar services in the City of Indianapolis. 3. This grant of permission shall be in force and effect from and after the passage of this ordinance by the Board of Trustees of said Town of Lynhurst and the filing with the Clerk of said Town of a certified copy of the acceptance Sheroot by the Bogrd of Directors for Utili- £ of the City of Indiana 9 4.
