TO TEST STATE TRUCK TAX ACT
Private Truckers Inc. Plan Court Attack on Weight Law.
Allied with a score of industrial associations, the Private Truck Owners: of Indiana, Inc. today be- _ gan raising a ‘“war chest” to pay costs of testing constitutionality of the Truck Weight Tax Act in state courts. At a dinner meeting in the Athenaeum last night, Albert Stump, the organization's attorney, told truck operators this tax, which he
said he believed was unconstitutional, was designed to raise $1,250,000 annual revenue. The Weight Tax Act, sponsored by Governor Townsend, was passed by the 1937 Legislature following a ‘ pitter floor fight. It was one of a number of measures introduced by

mission. Plan of the Private Truck Owners is to have Indiana truckers pay 6 to 7 per cent of the amount the tax will cost them into a pool to finance litigation. Mr. Stump declared the act was unconstitutional because the tax falls heaviest on those who are trying to make their trucks the safest by increasing the number and size of tires. The law does not come under the police power of the State since it provides for no regulation of truck traffic for the general welfare, he said, and it is not based on highway use.
‘In Reality a Tire Tax’
“This so-called weight tax is in reality a tire tax,” he said. ‘We now are in the midst of a safety
drive, and in my judgment that interest will not die down.
“Instead of promoting safety, this act works just backwards. Truckers will use lighter tires and cut down on the number of wheels on their trucks ta avoid tax payment, and this will increase accident hazards. “The tax is inequitable. Consider the fact that to levy a tax on interstate commerce also is beyond the power of any State government,” he said. C. W. Abraham, secretary, said: “This law is unfair because 85 per cent of the passenger cars using the highways are using them for commercial purposes. The law doesn’t place the tax on ‘commercial vehicles’ but specifically states ‘trucks, tractors and trailers.” “The money the State hopes to raise from truckers is to be diverted from State Highway funds into the general fund and is to be used to increase’ the annual state aid to teachers from $500 to $700 per teacher,” he said.

Mark Twain Roustabout Club members are looking forward to their annual Ohio River cruise, “Commodore” Dan V. White, Municipal Court judge, announced today. Members will board the steamer Gordon C. Greene at Cincinnati Sept. 25 for a trip down the Ohio River to West Point, Ky. stopping at other Kentucky ports, including Louisville, and return. Governor — Townsend, Senator VanNuys and Mayor Walter C. Boetcher have been invited to join the club. Judge White, Judge Wilfred Bradshaw and a small group of county officials, attorneys and newspapermen founded the club which has grown to approximately 150 members. For the last seven years the dlub has made a trip.on the Ohio River.
