COURT UPHOLDS CHILD - PACT IN $1,250,000 WILL

Colorado Woman Permitted To Sue for Share in Silver. Fortune.

DENVER, |Colo., Sept. 14 (U. P) —A child adopted by contract and without formal court approval may sue for a share in the will of the

foster parent, the State . Supreme Court held today In sustaining the action of Mrs. Magdalena Catherine Dominguez, of Santa Fe, N. M.

Mrs. Dominguez is contesting the. will of Mrs, Lena Allen Stoiber, whose estate|is valued at $1,250,000. She says she was adopted; by Mrs. Stoiber at Cave Girardeay, Mo,; in 1891. when she was 12. SHe was ‘the daughter of Mr. and Mrs. Wilheim Hoffman. i Mrs. Dominguez bolstered her claim with the following contract, written on the fly leaf of the Hoffman family bible: “Cape Girardeau, Mo., Oct. 10, 1891, Saturday a. m. “Lena Allen Stoiber took for adoption Magdalena Catherine HoiIman to enjoy the Stoiber home as her own for life and be entitled to a daughter’s share at my death.” (Signed) Lena Allen Stoiber. The Stoibers made their fortune froin the Silver Lake Mine, Silvertown, Colo.

FIVE SELECTED FOR SHORTRIDGE COUNCIL

Five new members and two alter- - nates were elected to the Shortridge High School Student Council. The council consists of 14 students. | Students: who will serve on the - council this year are, Edward Ziegner, Madelyn Paugh, Howard Wilcox, Margaret Zapf, Bill Stautz, Virginia Burholder, Warren Underwood, Harvey Hunter, Claire Patten, Phyllis Hadden, Jean Elliot, John Osborne, Victor Jose and Jack Brown. Alternates are Jack Anderson and Mary Scott Morse.

FT. HARRISON AWAITS NEW COMMANDER

Col. Louis A. Kunzig will arrive tomorrow to assume command of the 11th Infantry at Ft. Benjamin Harrison. He will be acting post commander while Brig. Gen William K. Naylor is on leave of absence. He is a graduate of the United States Military Academy and has served in a number of posts in this country in addition to service in the Philippines. Hs is married and has four children.

CATHEDRAL SCHOOL BOOSTERS TO MEET

A mass meeting in the Cathedral High School auditorium is to be held at 8:15 p. m. tomorrow to form a Boosters’ and Patrons’ Club. Brother Agatho, principal, announced invitations had been issued to all graduates, fathers of present students and friends and patrons. Present school enrollment is 530. He said the Megaphone, school publication, is to be resumed this year.

RELIEF CORPS TO MEET

The Joseph R. Gordon Woman's Relief Corps 43 will meet at 1:30 p. m., Friday in Ft. Friendly for a* social program. Mrs. Irvin Gamerdinger, Mrs. Charles Armel and Mrs. Naomi Hoffer are in charge of the program.
