COURT TEST OF INDIANA DIVORCE LAW IS MAPPED

the Indiana divorce law allowing a | decree on grounds of incurable in- | sanity, today was being prepared by |
the Attorney General. The test is to be based on a divorce decree granted in Marion | County Superior Court last October. | Two points are to be brought out | in the State's brief, it was said. It will contend that the law ‘is in- | definite and that the classification |

and unreasonable. Holds Law Conflicting Under the law, passed in 1935, a divorce may be granted when one | party to the marriage has been de- | clared incurably insane and pi mitted to an institution for five vears. The Attorney ‘General is to | point out that the law is conflict- | ing, since no divorce could be grant- | ed unless the person is committed | to an institution. Another point to be brought out in the appeal is that the Indiana | law contains no provisions for main- | taining the defendant in the suit | after the divorce, but allows a discretionary or voluntary action. The original divorce suit was filed | in the Marion County ‘Court in No- | vember 1935 and the ‘decree was | granted last ‘October. Marion | County Prosecutor Herbert Spencer, John '‘G. McNutt, Humphrey C. | Herrington and the Attorney gor | eral are to be counsel for the State.
