{ | { Hearing on the City's petition to dissolve a suit which would enjoin the City from beginning construc- | tion work on the Warfieigh main Sewer was to be resumed today before Circuit Judge Earl R. Cox. The petition to dissolve was filed by the City Attorney's office vestarday after Judge Cox granted an order Monday temporarily restraining City Engineer Henry B. Stesg from starting work on the $145.000 job, and City Controller Walter Boetcher from selling bonds for financing the project. The suit asking the restraining! order pending consideration of a permanent injunction charged { Works Board officials with failure! to award the contract for the Warf- | leigh project to the lowest responsible bidder. The contract was awarded to A. Acari on a bid of $145,401. The lowest bidder was the Jefferson Construction Co., with $128,000, accord- | ing to the suit. !

These candidates are to be given examinations and the six making highest marks are to receive employment in the department. These men are to take readings of smoke density around industrial

Offenders to be Warned

The latter campaign, although planned, has not yet been placed into effect, Mr. Clinehens said. Once the tests have been made, the offenders are warned by the smoke abatement department to eradicate the nuisance. They may either change the type of coal used or the combustion equipment. If they fail, they are liable to a fine under a city ordinance. Mr. Clinehens said he expects to issue 23 additional warnings soon. If he does, this would bring the total number of offenders warned to 48.
