Fines Avevage $10
“As T said before, I do not know how heavy fines your judges here impose. But in Columbus, O., fines for speeding, running red and preferential streets do not average less than $10. And in Milwaukee, it is a question of whether a speeder will pay $10 or twice that amount. “However, in some cities the con-
viction rate is low, not through the |
fault of the judge, but because the officers do not know how to make
a presentable case against a traffic |
offender. of value.”
That is where my work is
Mr. Kreml modestly asked that |
his staff of 12, which has set up bureaus in 15 cities and are planning to operate in several others, be
given credit for the success of the |

in right cases. Judgment was with- | held or suspended in three others.
Those present at the conference |
who pledged themselves to “unlimited co-operation” were: Chief Morrissey; Theo Dammeyer, Safety | Board president; Judge Dewey My- | ers of Municipal Court, Room 3: | Judge Charles J, Karabell of Mu- | bert M. Spencer, Deputy Prosecutors | Arthur Sullivan and John Cooper, |
and Lawrence McCarthy, aid to Mayor Kern. Program Outlined The program Lieut. Kreml out-
lined for Indianapolis is as follows: 1. Select 5C or 60 men from the police department. Certain standards would govern the selection. 2. Train them in accident investigation work. They would be instructed in elementary physics for determining the speed a car had | been traveling and in rules of evi- | dence. 3. When the system is in operation, all other police squads would
4. The trained investigators would assemble complete and accurate data on accident causes. 5. They would investigate each | mishap to determine whether or not a law violation has been committed. Along this line, they would interview witnesses, secure written statements and subpena witnesses to court. | 6. They would sign the affidavits | themselves and appear as prosecuting witnesses against offending drivers,
Legality Questioned
The latter point drew considerable | comment from Judges Karabell and Myers and Prosecutor Spencer. They questioned the legality of affidavits signed by officers who did not witness the offense committed. Lieut. Kreml said that counsel for the International Association of Chiefs of Police safety division, of which he is director, has found opinions by attorney-generals in the various states giving courts the right to admit such evidence. He cited cases supporting his claim. The conference was interrupted while a messenger brought the law books. “Well, we'll furnish the affi- | davits,” Prosecutor Spencer agreed, ! “then it’s up to the courts.” “We'll do what we can,” Judge Myers said, “but remember our courts do not have final jurisdiction if an appeal is made.” The conference evolved into an|

Lieut. Peak asserted that some intersections in Indianapolis have had as many as 11 accidents so far this year. Chief Morrissey pointed out that the new setup would involve some expense on the part of the City Lieut. Kreml replied: “Of course the City must spend

partment. He scored “fixing” as a detriment to traffic safety work. “Each case should be heard by the courts and not executive officers,” he said. He described the practice as a “leak in the dike which would ruin the best of programs.” “There must be a conscientious, nonpartisan feeling about the necessity and desirabilily of reducing accidents,” he stressed. Mr. Dammeyer said: “There is nothing we would not do to help cut down the accident death rate.” “With your co-operation it will be reduced at least 25 per cent next year,” Lieut Kreml replied.
