Sea Picture, Burns Farce, Are Popular

Summer Tradition Broken As Patrons Show Varied Taste.

Defying theatrical dog days, Loew’s and the Circle announced today that their current pictures, respectively “Captains Courageous” and “Mountain Music,” will be held over for a second week

beginning tomorrow. Besides breaking summer tradition, the fact that two downtown houses are holding over attests the public’s versatile taste. Both pictures are succeeding without several qualities usually thought necessary for a “smash.” Loew's picture hasn't a “glamour gal” in the nearly two hours it’s on the screen. “Mountain Music” is pretty shy on story interest, among other things. But people are crowding to see them, and surely not for the same reasons. The interest in. “Captains Courageous” is, I think, a very healthy symptom. It shows that appreciation of the artistic virtues of subtlety and restraint isn’t confined to the legitimate theater-goers. Here is a picture in which acting scores a decided triumph over a not-too-outstanding plot outline, and the fine performances of Spencer Tracy, Freddie Bartholomew, Lionel Barrymore and all the rest are reaping their merited box-office reward. It’s Cinch for ‘Ten Best’ “Captains Courageous” is a cinch for one of the year’s 10 best pictures; I think audiences as well as reviewers will agree on that. How the picture moved into the “surething class was by scrapping all of Hollywood's stock dramatic tricks. A few years ago the Kipling story almost surely would have been changed to include a fight aboard ship or a storm at night, with wind howling through the rigging and spars toppling all over the place. Not so with this film, however. It has the high artistry of simplicity, and is doubly poignant as a result. Producer Louis D. Lighton and Victor Fleming, veteran director, have shown us that M-G-M's reputation for producing fine pictures when it puts its executive mind to it was not endangered noticeably by Irving Thalberg’s passing. “Captains Courageous” is an achievement of which any of Hollywood's “greats” might be proud. “Mountain Music,” on the other hand, is an unpretentious farce. It seems to be going over because of a large and loyal following that Bob Burns has picked up in the last year. Bob's available weekly by radio, and through his daily column in The Times, have convinced patrons that he is funny. Consequently his audiences have the confident determination to be amused even before they enter the theater. Fortunately, Bob doesn’t let his public down. In spite of a harumscarum story, the picture gives Mr. Burns ample scope for his antics, not to mention those of his costar,

Carole Signs For 3 Years

Selznick Adds Lombard to Talent Roster.

Times Special HOLLYWOOD, June 24.—David O. Selznick today added another star to his talent roster when he signed Carole Lombard to a contract calling for at least one picture a year for three years. Miss Lombard, now costarring with Fredric March in “Nothing Sacred,” is left free, under the terms of the contract, to fill outside commitments. The negotiation is in line with Mr. Selznick’s, policy to corral top ranking names for future productions, and is the second such deal completed this year. Douglas Fairbanks Jr. recently was given a similar, one-film-a-year contract. His first asignment for the producer was “The Prisoner of Zenda.”

By United Press PASADENA, Cal, June 24—The lightning footwork of Fred Astaire and Ginger Rogers on the screen was attributed today to knock knees. Dr. William F. Madsen informed the California Osteopaths Association convention that the anatomy of the hips, thighs and legs puts the knees in “knock” position when they are properly supporting the body's weight. It's an asset, he said. Theodore Kosloff and Fanchon Wolfe and all other topnotch dancers are knock kneed. So is allAmerican football tackle Ed Wideseth of Minnesota when he crouches to hit the line. : Dr. Madsen said the fat and flesh may: give a deceiving appearance of straight or crooked legs.

assessable on “dubbed” films (in which Italian actors make the sound portion of foreign films) and a provision that movie theaters must show one Ttalian film for every two foreign pictures shown. Hitherto three foreign films to one Italian film was the prescribed ratio. The “dubbing” tax is increased from $1575 to anywhere from $2625 to $5775 according to the amount taken in at the box office on individual films.

The minimum tax would be imposed on films which draw less than $131,250, An additional sum would be imposed as this total was increased until the maximum tax is imposed on films which draw $210,000 or more.

Freddie's Aunt Attacked In New Custody Battle

LOS ANGELES, June 24.—The attorney for the parents of Freddie Bartholomew today accused Myllicent Bartholomew, aunt and guardian of the 13-year-old English screen star of “trifling and imposing” on the Court in which she seeks to reopen guardianship proceedings.

Motions to set aside previous court orders and stipulations, one of which gave the parents, Cecil Lewellyn and Lilian May Bartholomew, a share in the earnings of Freddie, were made by attorneys for the aunt, who adopted the boy.

Former Judge Isaac Pacht, attorney for the parents and a bank which is guardian of the boy's estate, jumped to his feet in Superior Judge W. Turney Fox’ Court and began an attack upon Miss Bartholomew. Argument centered upon the question of the jurisdiction of Superior Judge Harry B. Archbald, who approved the stipulation, to make such orders. Attorneys for the aunt contended that because there was no testimony, the Court had no jurisdiction to approve the stipulations.
