The City Sanitation Department today was in a position to continue its drive against private. garbage collectors after the State Supreme Court had ruled in favor of the city ‘collection system. |

The city ordinance was upheld in ' a case against Frank R. and Carl C. Ryan, who were collecting garbage from restaurants for livestock feed. Works Board members recently -have appealed to householders in ‘their attempt to prevent private col‘lections. Ernie Frick, Works Board secretary, estimated that the decision would mean increased revenue to the city of approximately $25,000 annually. He based his estimate on the $7.53 a hundred pounds the city ‘receives for grease made at the incinerator plant, Among other decisions handed down yesterday was a ruling upholding the state Optometry Registration and Examination Board in an appeal from the Shelby Circuit Court, The case was started by a Hammond optometrist, himself registered, but employed by a nonresident, non-registered firm.

Constables Lose

The St. Joseph Circuit Court was | ‘upheld in another decision in which the Supreme Court ruled that two former township constables must serve a 2 to 14 year sentence for conspiracy, taking bribes and false personation. The two men, Otto Switzer and William Bushong, were convicted in 1635 on charges of obtaining money from alleged ‘“bootleggers” by posing as State and Federal officers. | Judge Michael J. Hughes ruled that the Carroll Perfumers, Inc., a Ft. Wayne concern, must operate under a permit from the state Pharmacy Board. The appeal from a Warrick Circuit Court in the election contest brought by Warren W. Martin, defeated Democratic candidate, was denied when the lower court was upheld.
