3-WAY ATTACK | BEGUN AGAINST TVA INJUNCTION
Authority - Appeals Ruling Blocking Program of Expansion.

A three-way attack against a Federal further expansion of the Tennessee Valley Authority's power project . Was made today before the U. S. Circuit Court of Appeals here by James L Fly, TVA general counsel. The attack opened a hearing on the Authority's appeal from an inJunction granted by Federal Judge John J. Gore of Tennessee which
has halted - TVA expansion since Dec. 22.

asked the restraining order pending disposition of a suit to determine TVA's constitutionality. Mr. Fly asked the Court to overrule Judge Gore's injunction on the following counts: - 1. The suit should have been brought in the Northern District of Alabama, “where the TVA is domiciled,” instead of the Eastern District of Tennessee. ~ 2. There is a misjoinder of plaintiffs. Several of the 18 companies in the suit do not have any direct interest in the suit.

3. Judge Gore erred in presuming TVA was only a power program ignoring the Supreme Court decision in the Ashawander case which
recognized the broader aspects of TVA's flood control program. “The case which the 18 companies bring to this Court today,” Mr. Fly said, “is an awful collection of debris from the Ashawander case which the Supreme Court has already decided.” The Ashawander case brought by private utilitysinterests against TVA was decided in the Supreme Court in March, 1936, with .a victory for the Government. In this case the Court did not rule on broad aspects of TVA but upheld the right of the TVA to manufacture, transmit and sell power generated at ~ Muscle Shoals, Ala.
