By United Press SAN FRANCISCO, April 14 —An appeal for the release of Thomas J. Mooney from San Quentin Prison, where he is serving a life sentence for the Preparedness Day bombing

in 1916, was resumed today before |}

the state Supreme Court by Chief Defense Counsel George T'. Davis. Davis expected to end his argument today. For two days he has attacked the findings of a Supreme Court referee who presided over the taking of evidence in the case, and he has challenged the testimony given by two alleged eye-witnesses at Mooney’s original trial, 21 years ago. The witnesses named were John MacDonald and Frank Oxman. Davis said Referee Addison - E. Shaw “struck everything from the record dealing with Oxman on the ground that it" was immaterial.”. The lawyer said Oxman’s description of Mooney given in an affidavit before the trial differed from his description on the witness stand. Today Davis was expected to attack the testimony of Millie and Sadie Edeau and to review the testimony of Mrs. Belle Hammersberg, Mooney’s sister-in-law who was said to be the only person still alive who stood with Mooney when the explosion took place in the street. Mooney’s friends contend that he was convicted on perjured testimony in a frame-up against union labor.

THEFT REPORTS UP, SAFETY BOARD TOLD

$13,900 Increase in Stolen Property Recorded. Complaints of burglaries and rob-

beries received by the Police Department this year to date show an in-

crease of 18 and 35 per cent respec-

tively, according to a report on file today with the Board of Safety. An increase of $13,986.21 in stolen property to date this year over the same period last year also was reported. A like increase in amount of stolen property recovered was shown. Property worth $220,570.76 has been stolen so far this year as against $206,584.55 for the same period last year. To date this year 23 persons have been convicted of burglary out of 57

arrests. Fifty-six convictions were reported out of 103 arrests. The department - has received 608 complaints against burglaries and 181 reports of robberies this year.
