POPULAR RIGHTS NOT IN DANGER, MINTON HOLDS

Court Curb Would Not Bring Oppression by Congress, Senator Says.

Times Special WASHINGTON, Feb. 4. — Congress, as well as the courts, is perfectly capable of preserving the rights of the people, Senator Sherman Minton contended in a speech here.

The junior Senator from Indiana took the floor after Senator Joseph W. Bailey (D., N. C.) had contended that to pass a law curbing the injunction power of Federal District Courts in declaring laws unconstitutional, as proposed by Senator Kenneth McKellar (D. Tenn.) would be “immoral.” “I think the Senator does too much honor to the distinguished men who occupy the bench of the District Courts of the United States,” Senator Minton said, “when he envisions a period when the Congress of the United States has become so depraved that in a highhanded and roughshod manner it will ride over the constitutional rights of the people of this country and that the people's liberties depend solely upon some judge on the bench of a District Court out in some state of the United States who possessess the morality to strike down such a law. “We secek no -unseemly contest with any other branch of government. We merely seek to pursue in our own way what we conceive to be our own constitutional right. “Throughout the long history of this country, and the exercise of the power of the Supreme Court to declare acts of Congress unconstitutional, I challenge any man to point to any opinion of the Supreme Court of the United States and say that but for that opinion the Congress of the United States would have ridden roughshod over the people and jeopardized their liberties and their rights. “So I rise on this occasion in de-

Yes; it is, and I assert that is a good record for the Congress. So only in that spirit would I defend the morality of the Congress of the United States.”

CHARGE TAMPERING WITH EXCISE FUNDS

Examiners Report Shortage $62 After $3900 Is Repaid.

Details of an alleged shortage in State Excise Department accounts involving two former employees were sent to Prosecutor Herbert M. Spencer yesterday by the State Accounts Board.

The report shows that $3920 has been repaid, and that $62.50 re-

meyer and Carl Coble, Accounts Board examiners, said. Raymond H. Wyman, Shoals, former excise chief clerk, is alleged to have stated that he converted some of the money to his own use, but later repaid it. James L. Carrico, Daviess County, former stamp sales clerk, is al-

leged to have paid certain moneys into incorrect accounts at the direction of Wyman.
