COURT VERDICTS ON TENURE ACT ARE UPHELD
Legislature Not Bound -by Previous School Law, High Tribunal Rules.
The Legislature is not bound by previous legislation in its control
over the State public school system, the Supreme Court has ruled in two decisions. With one dissenting vote, the Court yesterday affirmed the decisions of the Wabash and Vigo Coun- . |ty Circuit Courts which granted township trustees the right to release school teachers in accordance with the 1933 Teacher Tenure Law amendment. The Tenure Act, passed in 1927, provided that “a person who has served for five or more years as a teacher and shall thereafter enter into a contract for further service

shall become a permanent teacher.” The amendment four years ago made teacher tenure applicable only to city and town school corporations.
Property Rights Claimed
Two teachers, who had held township school positions under the Teacher Tenure Law and who were released after the Act was amended in 1933, claimed that they had vested property rights in their indefinite contracts which could not be impaired under the Constitution. In affirming the judgments of the lower Courts, Judge Michael Fansler, who delivered the Supreme Court opinion, said: “The establishment and maintenance of public schools is a governmental function, jurisdiction over which is vested in the General Assembly. This legislative power is not exhausted by exercise and schools may be continued or discontinued as often as the Legislature deems necessary.” The Tenure Law does not purport to give a teacher a permanent or definite contract.” Judge Walter Treanor failed to concur.
