TT The 100th seat in the House of Representatives — vacated by the death of Rep. James A. Moody (R., Fremont)—may not be filled in the 80th session of the General Assembly. : The House today was expected to notify Governor McNutt of the vacaney. Legislators familiar with House rules say the Governor then - must decide whether a special election will be called to name a successor to Mr. Moody.

House observers point out that in |.

the ‘last regular session a Republican vacancy was unfilled because the Governor failed. to call a special election. The Fremont Segielalor represented Steuben and Lagrange Counties, which are normally Republican. Rep. Moody, farmer and building and loan company officer, died of pneumonia shortly before the House opened. Never an active debater, Rep. Moody rarely obtained the House floor except when farm legislation

or tax measures were being con-

sidered.
