The formal charge against Helms “and Mendenhall was listed on the | indictment as “common barrator.” The indictment was returned after the jury had investigated for two months the filing of 71 suits against ‘the Sacks Brothers Loan Co.
Claimed Charges Excessive
: The suits were brought by Helms | ~ 8nd Mendenhall on fenalr of persons who had obtained leans from | ithe Sacks company. They charged | that the company had attempted to | ‘circumvent the State Petty Loan | Law by charging excess insurance premiums on autos held as security |
for the loans. Seventy-two suits originally filed by the attorneys in Superior Court, five were dismissed by Judge Her- | bert E, Wilson two months ago “for | ‘want of prosecution.” | Judge Wilson then recommended | 8 grand jury investigation. Two weeks later the attorneys refiled T1 of the suits and County Clerk Ralston sent notices to the 72 former | plaintiffs demanding payment of _ court costs amounting to more than | $600. Many of the plaintiffs said they didn’t know the suits were filed | in ‘their behalf, according to Prosecutor Herbert M. Spencer. The indictment against. Sachs | charged that he falsely certiffed al ‘change of venue affidavit in the case ' of Carl Rugh vs. Max Sacks.
