By United Press WASHINGTON, Dec. 8.—The Senate railroad investigating committee learned today how the late brothers, O. P. and M. J. Van Sweriznigen regained control of their vast -railroad empire without putting up a cent when their securities were gold at auction by New York bankers in 1935. George A. BH, elderly Muncie (Ind.) fruit jar manufacturer, who came to the financial rescue of the brothers when ‘banks foreciosed on $40,020,000 in defaulted loans, revealed the Van Sweringens were given a 10-year option to regain outright control of the system. Ball and George A. Tomligson, Cleveland shipper, advanéed most of the $3,121,000 used to purchase the collateral securities on the auction block in New York. Under their agreement with the brothers; Ball revealed, the latter were to remain connected with management of the companies, with the right to regain control later. Revelation of methods used by Van Sweringens’ io avert an n capie during the committee's iny¥stigation of railroad financing methods, which may be culminated ‘by proposals for Federal regulation of railroad financing.
