STATES JOIN NDIANA AGAINST PASSENGER SUIT

Motorists’ Guests to Have

Hard Time Collecting Damages, View.

. Twenty-five states have joined Indiana in adoption of “guest-suit Jaws,” limiting lability of car owners for damages sustained by nonpaying passengers in the car, according to Todd Stoops, Hoosier Motor Club secretary-manager. “Under the common law of acciderit damage,” Mr. Stoops explained, “the operator was held accountable at law ior any injuries suffered by other his car whether or not the driver was at fault in the accident.” Guest-suit laws, enacted to correct many injustices, provide that passengers can not bring suit against the driver of a car unless they can prove gross negligence or an intentional act of carelessness, Mr. Stoops said. . The Hoosier Motor Club sponsored the law in Indiana and it ; as passed by the Legislature in

: “The practice of giving rides to hitch-hikers is dangerous everywhere, but in states without such laws there is the added hazard that the motorist may be faced with a costly suit brought by the hitch-hiker in the event of an accident,” Mr. Stoops asserted.
