This belated interpretation of the court majority’s opinion is back of the Administration decision against including a constitutional amend-

form, it was reported today.
It is also upon this interpretation | 7A that New York and 11 other states |}
have decided to continue to enforce their laws providing for minimum ' Wages for women in industry.
Interpretation Outlined The new interpretation of the :najority opinion by Justice Butler is legalistic but apparently logical. It is about as follows; The court, in the Tipaldo case of June 1 made its ruling on just one
point—whether the 1933 New York |=
law involved came under the same classification as the District of
Columbia law which the court had knocked ‘ ouit, 5-fo-3, in the’ 'celebrated Adkins case of 1923.

Approval Considered
This, it is argued, leaves the way clear for the court. to, overrtile at any time the fundamental constitutional points of the 1923 decision. This point is further offered as-a clew to the reason why Justice Roberts, who had upheld wide state price-fixing powers under “due process” in the Nebbia milk case, went
