SINKING FUND ACT IS UPHELD High State Court Verifies Constitutionality of 1932 Measure. The Indiana Supreme Court has upheld constitutionality of the state sinking fund law passed in the 1932 special session of the Legislature for reimbursement to governmental units for funds lost through bank closings. Written by Justice Michael Fansler, the high court opinion reverses part of a decision by Superior Judge Clarence E. Weir, Marion County. The case started when Timothy P. Sexton, then Marion County treasurer, filed petition for a declamatory judgment to determine his duties under the sinking fund act. Judge Weir held that interest on certain public funds was to be turned over to the sinking fund, but that interest on other funds was to be held by the county treasurer. The Supreme Court today also had upheld the validity of a 1929 act which makes the state, counties and municipalities liable for damages caused by their employes while driving automobiles. The decision, written and handed down yesterday by Judge Fansler, held that counties are specifically liable for damages. The case was appealed from Franklin Circuit Court, which had held that the law was so written that counties were not made liable. This ruling was against Herman L. Steinkamp, who had sued for damages against Decatur County as the result of an accident involving a county-owned automobile.

FATE OF BRUNO RESTS ON QUIZ OF DJMONDON Hoffman Infers He Has No Evidence as Basis for Reprieve. By United Press TRENTON, N. J„ March 6.—Gov. Harold G. Hoffman made it apparently certain today that Bruno Richard Hauptmann’s hope for life lies with a state motor vehicle inspector en route South to question Dr. John F. (Jafsie) Condon. The Governor rested, wearily, on his unqualified admission yesterday that he had no legal power to reprieve Hauptmann again and his inferential statement that he had obtained no evidence he thought would earn the Lindbergh baby killer anew trial. The inference was read easily into his statement that he no longer would try to postpone Hauptmann’s execution “unless something arises that will bring Atty. Gen. David T. Wilentz and myself into agreement on a motion based on new evidence.” Hauptmann is scheduled to be electrocuted the week of March 30. Bound for Panama Andrew Dutch, motor vehicle inspector, thus became Hauptmann's chief hope. Dutch was aboard the liner Georgic, bound for Panama and Cuba. Hoffman denied in New York last night that Dutch had instructions from him to see Condon, who paid $50,000 ransom for the Lindbergh baby and identified Hauptmann as the receiver. But Hoffman has persistently questioned “obscure” points in Condon’s testimony and expressed a desire to quiz him.
