BOEHNE TALKS ON POWERS OF SUPREME COURT
Restriction of Tribunal's Authority Discussed Pro and Con. Time* Kperlnl • BALTIMORE. March 5. Rep. .John W. Boehne Jr., Evansville, toriay presented the pros and cons regarding restriction or abolition of powers of the Supreme Court to delare laws unconstitutional in ad- * dressing the Johns Hopkins University student body. He termed his talk a sort of oneman Town Hall and asked that interested students write him their reactions. Upholding the court, Mr. Boehne said: To those who contend that a change of some kind is necessary, may I direct these questions: ' If the framers of the Constitution did not intend to subject Acts of Congress to judicial review, and still did not intend that Congress should have unlimited power, then what check upon Congress did they intend to impose? "Congress holds a check upon the Executive and Judiciary through the power ol impeachment, but who holds a check upon Congress?” Closes Argument for Court In closing the argument for the court's powers, I.Tr. Beohne concluded : "I maintain that a court with this power is necessary in a union of sovereign states. It is necessary to the preservation of order and as a protection against, the tyranny of the majority.” Reversing his role, Mr. Boehne I hen outlined arguments for such changes as requiring decisions on constitutionality to be unanimous or taking this entire power from the Supit-me Court. Decisions Political Opinions "Such decisions of our courts are mere political opinions and not judicial decisions,” he contended. "They are wholly unauthorized by the constitutional laws and traditions of our form of government. "How long will the American people permit the courts of America to defeat the expressed will and intent of the people of this country by voiding and destroying the laws that people are demanding? "By a decision of five to four, will they continue to permit this court to deny their legislature the right

Mr. Boehne was invited to speak at the school by Mead Johnson, a student from Evansville.

LOCAL POLICE TO TAKE PART IN RADIO TEST Experiment May Lead to Nation-Wide Network, Batts Says. Indianapolis’ police radio today was one of five Midwest experimental stations broadcasting coded telegraphic messages for a sp&cial re :eption test at Kansas City, Mo. Object of the tost, according to Capt. Robert L. Batts, local polite radio director, is to determine the feasibility of a nation-wide inter-city hookup. Such a national network, he said, would be used exclusively for broadcasting police messages in telegraphic code. Conducting today's test was Lieut. Roy De Shaffon, who with a squad of experimental workers, was to attempt to pick up the the various broadcasts while cruising in the Kansas City area. As head of the Kansas City radio system, Lieut. De Shaffon is leading the campaign to establish the national hookup. Should today’s experiments prove practical. Capt.
