JAMES ASSURES SENATORS HE'S NOT IN POLITICS U. S. Marshal Won’t Be Asked to Quit; Kin to Build School. BY DANIEL M. KIDNEY Time* Staff Writer WASHINGTON, Jan. 23—Federal Marshal Charles James of Indianapolis told the Indiana Senators today he is not a candidate for the Democratic nomination for Governor, thereby eliminating: the embarrassment of being asked to resign his marshalship. He also reported that he had resigned as Jennings Township trustee in Scott County, but that no successor had been named. Mr. James is president of the Indiana Township Trustees Association. "I a..i still helping with the work in Jennings Township at Austin to get the schoolhouse built,” Mr. James told The Times. Low bidder ,on the schoolhouse, which is to be financed partially by a PWA loan, was Ivan Morgan, brother-in-law of Mr. James, and one-time Republican state chairman. Morgan Seeks Economy Mr. James explained that since Mr. Morgan, capitalist and largescale canner, had to pay most of the taxes at Austin, he (Morgan) decided to bid for the schoolhouse and build it as economically as possible. He has his own building organization which he uses in building canning factories, Mr. James said. "However, we may need more PWA funds,” Mr. James continued. ‘‘We got about $24,000 at first, figuring on the building costing about 60 per cent more than that amount, but with materials and labor costs rising it will be $70,000 at least. 3o now we are going to get new bids. I expect Ivan will be low again. "He will build it a lot cheaper than the one they got $29,796 of PWA funds for in Vienna Township in Scott County.” Confers With Senators Arriving here yesterday afternoon, James conferred briefly with Senators Frederick VanNuys and Sherman Minton. He is to confer with them again today. Both Senators pointed out that Federal regulations require that an appointee resign if he becomes a political candidate. Senator Minton is scheduled to decide, with Mr. James, on a successor to the deputy marshalship position resigned by William McQuirk, Terre I'aute. Senator VanNuys said Mr. James Is also here to consult with Federal authorities regarding plans for the execution of George W. Barrett, who is to be hanged at Marion County jail March 24. Nolan Also In Washington -District Attorney Val Nolan, who prosecuted Barrett, also is in the city. He says that his visit has nothing to do with that of Mr. James. Yesterday he conferred with officials at the Department of Justice and today with both Senators. Mr. Nolan has been mentioned as a possible successor, by appointment, to Senator Minton's seat should the latter be appointed to a Federal judgeship. But mast, likely successor would be Dr. Carleton B. McCullough, it is reported here. Senator Minton says he is not asking for the appointment.

NEW GROUP TO PICK SUCCESSOR TO AU-EENEY Four Former Members Are Renamed to Committee for Milk Shed. The newly appointed milk committee for the Indianapolis marketing area is scheduled to meet today to nominate a candidate for milk administrator, a post vacated by A1 G. 1 eeney in an ouster move demanded by the former milk shed committee. Four of the former committee, which resigned at the request of the State Milk Board after asking Mr. Feeney's dismissal, were renamed yesterday to the new committee. The committee, as required by law, is comprised of five distributor representatives and five producer representatives. New members include John Bright Webb, state senator from Marion County and State Board of Abriculture member; Edgar Wilson and Chester Parker, producer members, and Cecil Buchanan, Arthur Holt and Clarence Hill, distributor members. The official explanation given for Mr. Feeney's dismissal and request for resignation of the old milk committee was that lrck of co-op-eration between the administrator and the committee made administration of the milk control law impossible in the local marketing area.
