JURY JUDGMENT TO BE DISPUTED BY FORMER COP Herschel Musgrove Is to Seek Arrest of Guilty Verdict. Arguments on a motion to arrest judgment of a Municipal Court jury which convicted Herschel H. Masgrove, former patrolman, of assault on Chief Morrissey Is to be heard soon. Musgrove was fined $1 and costs. Paul Rochford. the former patrolman's attorney, sought abeyance on the basis that the affidavit against Musgrove did not have the file mark of the Municipal Court clerk. He contended his client had been placed in Jeopardy and was tried on an illegal affidavit. Deputy Prosecutor James Watson answered by saying Musgrove waived his rights when he pleaded not guilty at arraignment on the alleged faulty affidavit. Charged With Striking Chief The discharged patrolman was charged with striking Chief Morrissey following an alleged altercation in tne chief s office. Chief Morrissey testified that Musgrove had been discharged for owning a siot machine. Musgrove countered in testimony by charging that, the quarrel ensued after he reminded the chief of occasions when he had aided Chief Morrissey home when he was in an alleged intoxicated condition. He said that at one time they had been “good friends.” During closing arguments. Mr. Rochford scored Chief Moifissey for discharging Musgrove berause he owned one penny gum machine and asked, "Why don't the chief go after some of the big one-armed bandits of the city." Their respective entries were gold medal winners at the recent North Judson Muck Crops Show. As the highest of 25 medal winners of the 400 Bushel Potato Club, Mr. Ort accounted for an average acre yield of 486.9 bushels. Like Mr. Gehring. whose 867.22 bushels an acre led the onion contest, he competed against entries from 20 north- , ern Indiana counties.
