TIRE CO. SUES RAILWAY FIRM Complaint in Account Is v Filed: Bus Official Denies Charge. The General T.re Cos. filed a complaint in account against the Indianapolis Railways and the Peoples Motor Coach Cos. yesterday in Superior Court asking Judgment of SBO,OOO. The suit that the tire company entered into a contract with ♦■he defendant firms for the lease and op'lon of tires for coaches. At ‘-ho ''.xpiration of the contract. Dec. 29 1034, the defendant firms are alleged in the suit to have agreed to purchase the tires. The complaint charges that the firms still owe the tire company $77 88*) for the purchase of the tires. the railway*, in a statement said that the suit “is over a controversy as to the number of tires, and the prices therefor, for which payment Is to be made. The amount sued for Is in dispute and Is grossly in excess of any sum that is justly due the General Tira Cos. “The suit grows out of the fact that the Indianapolis Railways. Inc , and the Peoples Motor Coach Cos., recently made a change in tire service for their equipment from the General Motor Cos. to another tire firm. ‘ Any sum that, may be found due General Tire Cos., on account of these tires Is assumed by the tire company which is now servicing the equipment of Indianapolis Railways and Peoples Motor Coach Cos., and is In the final analysis not an obligation of these companies.” W. J. Coughlin, General Tire Cos. president, said his company contends the street railway and coa-h line are responsible for the obligation. adding: “Bvery effort was made to compromise a fair settlement on the basis of the contract. When this became futile it was necessary to resort to the courts to receive proper consideration for the claim.”
