COURT UPHOLDS RIGHT OF NEGRO FOR JURY DUTY Victory Comes in Scottsboro Ruling: Meet Setback in Election Case. Bv Cmit'4 Pm WASHINGTON. April 2—Two rs the most important documents affecting the rights of Negroes since President Lincoln's emancipation proclamation were contained today In Supreme Court decisions. The court upheld the right of Negroes to sene on Juries, but held valid the Texas state Democratic convention action which prohibits their participating in a Democratic election. The latter decision placed a drastic ’••striction on the effective exercise of franchise by Negroes. It was the right of franchise which the emancipation proclamation guaranteed nearly three-quarters of a century ago. In setting aside the conviction and death sentences of two Negroes in the Scottsboro assault cases the court ruled the indictments on which they were tried were invalid because Negroes had been systematically barred from jury duty in Jackson County. Ala. The court ruled, in effect, that the nine Negroes charged with assault four years ago on two white girls must be either reindicted and retried by a jury drawn from a panel which includes Negroes or set free. Hughes Gives Opinion Chief Justice Charles Evans Hughes read the opinion which castigated the mode of trial and sustained the Negros’ contention their race had been barred from jury service. It was unanimous except for Justice James C Mcßeynolds, who took no part in the case. “It appeared that no Negro had served on any grand jury or petit jury in that ’Jackson) county within the memoir of witnesses who had lived there all their lives,” Mr Hughes said. After noting there were a large number of Negroes qualified for jury service in that county and that there was evidence the jury rolls had been tampered with and Negroes* names superimposed. Mr. Hughes said: “For this long-continued, unvarying and wholesale exclusion of Negroes from jury service, we find no justification consistent with the constitutional mandate.” Ilrld Voluntary Society The Texas decision barring Negroes from participating in Democratic primaries appeared to have given Southern states a means of legally disfranchising the race since the Democratic nominess almost invariably are elected. Several years ago the court set aside state constitutional provisions barring Negroes from the primaries. Tiie state responded with legislation giving the Democratic State Comm**tee the right to establish the qualifications of voters in the party. The Supreme Court decision said “We hold the party was a voluntary association and was competent to decide its membership.” The court held, however, that the state could not deny a Negro the right to vote in a general election because of his race. Retrial Is Certain Ay t Hitt 4 Prr*t MONTGOMERY. Ala.. April 2 Alabama officials today determined to prosecute the Scottsboro assault cases “to the end.” Few officials would comment, but they agreed there was no possibility the Negroes would be released without further prosecution. The course of procedure was undecided. It probably will involve addition of Negroes to the jury rolls in Jackson County (Scottsboro! and empanelling of a sp?eial grand jury to re-indict all the defendants. 43 ARE INITIATED BY LOCAL EAGLES AERIE Ceremonies Honor J. Pierce Cummings, former national Eagles trustee and twice Indianapolis aerie president. Other classes in his honor will be initiated April 15 and 29. LOCAL MAN SUES TO TEST MOTHER’S WILL Parent tnduly Influenced. Is Charge of Henry Litchenauer. A suit to break the will of the late Mrs Mary C. Litchenauer. 1705 N. Aiabama-st. was filed today in Probate Court by her son. Henry L. LiClitenauer. The suit charges that Mrs. Lichtenauer was of unsound mind when the will was drawn up and that undue influence was used in the writing of the will. Under the will the major part of the estate, valued at $20,000. was left to a daughter-in-law. Mrs. Pearl Lichtenauer.
