BILL SOUGHT BY SUPREME COURT JUSTICE BEATEN Congress Reiects Measure Involving Retirement ot Jurists. /■ - * WASHINGTON March B—The Supreme Court is mighty, but one of rs couShn't get a bill through the House this week to make the life of a retired Justice a little more comfortable. The hill also would have made it ea r for the Administration to get son:® of the ant I-New Deal judges off ’he bench, according to Republicans. But this was disputed by Democrats The measure was proposed by Chairman Hatton W. Sumners D., TANARUS x < h! the juriiriarv committee. v >,n disrlo-ffi that it was suggested to him by an unnamed justice. It ;i- also approved by Atty. Gen. H m r S. Cummings. But the House wasn’t in the mood, ar.d tfter objections on the grounds of economy the bill was beaten, 144207 on a roil call forced by Rep Thomas L Blanton 'D. Tex *, obstreperous watchdog of expenditures. Ihe bill would have remedied a condition which forced the late Oliver Wendell Holmes to take a pav cut after he resigned from the Supreme Court. Subject to Assignment Ju •:*■< now get $20,000 a year and under the Constitution their pav can not be nmunished during their Lite tenure of office. After they are 70 and have served 10 years on the hnihe.-t tribunal, they may resign and still remain on the pay roil. But their status as judge is ended, and Congress ran cut their compensation Thus the economy act w; applied to cut Mr. Holmes' retired pay 15 per rent Tin* Sumners bill would have author z- and ju ’ires either to retire or to r* ign If a justice retired, he u!i 'ill be a tudge and the constitu* ■! i! provision would forbid Cot. :• to rut hts pay. 1 ril rh trict and circuit judges air adv have this option. Ju f. • who ‘retired” under the bill in -ad nl rrsigning would have been subject to assignment on Cm lit C*urt of Appeals work—the same work the active justices used to do in the early days of the republic Tin* would have enabled the Che f Junto to provide a certain amount .f light work for an aged ju ti " > wa n’t quite up to the heavy duties of ine court. G O P Solidly Opposed Rep Christianson 'Rep. Minn) feared the proposal ' would have the effect of facilitating a change in the complexion of the Supreme Court if urh a change were desired The Republicans voted almost solidly against it. The Supreme Court m recent New Deal cases has divided 5-4, with the mod* rate liberals or progressives winning Justices who have served 10 years and ai past 70 include Willis Van Devniuer. James Clark Mcßeynolds and George Sutherland, all conservat;v and Chief Justice Charles E Hughes and Louis D Brandeis. who have upheld emergency legislation Pierce Butler, fourth conservative. will be eligible for retirement in another year.
