MEASURE AIMS AT REFORMS IN RECEIVER SUITS City Senators Introduce Bill to Safeguard Defendants. Receivership reform is the object of a bill introduced in the Indiana Senate today by Senator Leo X Smith (D . Indianapolis* and Senator Thomas A. Hendricks <D Indianapolis*. One of the most important features of the bill is the provision for protection of defendants in unsuccessful actions for a receivership. “It is to be remembered that when a receiver is asked for a corporation. even as an incident tc collection of a small amount, the corporation's credit is impaired.’’ Senator Smith asserts. “The filing of the receivership action immediately is reported by Dun A: Bradstreet and the credit agencies to their subscribers throughout the trade ” Under the Smith bill, defendants in unsuccessful receivership actions would be entitled to damages and attorney fees from the person or corporation asking the receivership Appointment of non-residents as receivers would be prohibited and unless good reason existed, an officer or employe of the defendant company would not be named a receiver. Another change would prevent attorneys for any party to the receivership or any other interested party, from acting as receiver. Courts not only would have the power to approve the receiver’s appointment, but also that of any accountant or other assistant. The present receivership lawfixes no compensation for receivers. The Smith bill also does not fix a scale, but provides for complete publicity for all amounts asked before there is an award. The petition for allowances would have to set out in detail services for which money is sought and any interested person could be heard in objection. Love Suit Bill Approved The House Public Morals Committee today reported favorably the bill of Rep. Roberta West Nicholson (D„ Indianapolis) banning breach of promise suits. The committee report, which included one minor amendment, was concurred in by the House. The bill would abolish civil causes of action for alienation of affections, criminal conversation, seduction and breach of promise to marry. It also prohibits identification of co-respondents in divorce and similar actions, unless ordered by the court. Mrs. Nicholson said she has received congratulations from a number of women since she introduced the bill.
