PRIVATE BANK PRECEDENT SET Shareholders Liable to Full Extent or Liabilities, Court Holds. Shareholders of a private, or partnership, bank are liable to the full extent of the bank's liabilities, including deposits in the bank, the Indiana Supreme Court ruled yesterday, establishing the legal precedent that liability in such banks is not limited to assessment equal to share holdings, as is the case with stockholders in banking corporations. Judge Walter E. Treanor wrote the court’s opinion, which came in a case appealed from Wells County.

There. Grover Essner, a depositor in the Bank of Tocsin, had brought suit against the bank's shareholders on behalf of himself and all other depositors. The Wells County Circuit Court held the shareholders liable for the debts of the bank under the common law liability of partners, but ruled that Mr. Essner could sue only for himself and not for other depositors similarly situated. The Supreme Court reversed this latter ruling, stating that Mr. Essner could sue on behalf of others as well as himself. CHILDREN TO ENTERTAIN Recreation Groups to Give Program at County Infirmary.
