WATER FIRM TO FILE EXCEPTION IN RATE CASE Appeal to Federal Court in Ward Ruling Set for Tuesday. Exceptions to the findings of Albert Ward, special master in chancery, in the water rate case will be filed Tuesday or Wednesday in federal court by Joseph J. Daniels, water company attorney. In a recommendation to federal court, Mr. Ward placed the valuation of the Indianapolis Water Company’s property at $20,500,000, as compared with the $28,000,000 claimed by the water company. If Mr. Ward's recommendation is accepted by the court, water rates in the city will follow the rate schedule established by the public service commission, instead of being raised, as the water company asked. Water company officials today declared that Mr. Ward's recommendation of 6 per cent as a fair rate of return on the company’s valuation conflicts with a previous ruling made by the United States supreme court. As the supreme court set 7 per cent as a fair rate of return a few years ago, company attorneys assert that a point of law is involved which can be carried back to the supreme tribunal. The federal court must abide by the supreme court's previous decision and not by Mr. Ward’s recommendation, they contend. The channel of the ancient Hudson river runs under the sea for many miles, showing that the land was once above the sea.
