ALLEGED BANK ! BANDiT LOSES IN HIGH COURT Convict Has Case, but He Can’t Get to Court to Try It. Francis Murphy, an alleged bank bandit, who claims he was sentenced for the Bridgeton bank robbery through mistaken identity, drew another blank from the supreme court yesterday in his long legal fight to get out of the Indiana state prison Murphy has been serving a ten j to twenty-one vear sentence since; April 30. 1924 In 1930 he received favorable action on a coram nobis petition in Parke circuit court, from which I he had been sent to the penitentary. I But he was thwarted from further prosecution of the case when habeus corpus actions in Vigo and Laporte circuit courts finally failed. His appeal to the high court was on the habeus corpus action, denial of which was sustained. So now Murphy is in the position of a man who has a case but can't get to court to try it. In the interim, the Parke county prosecutor has procured a writ of prohibition and the clemency board j denied parole. They claim that he has a bad institutional record. SOLDIER BONUS CONSIDERATION FACES HOUSE Veteran Bloc Lacks but 35 Votes to Bring Fight to Floor. | Bp T nited Press WASHINGTON. Feb. 14. The | soldier bonus issue bobbed up in the ! house today as a threat to the leadership when it was learned that the veterans’ bloc was only thirty-five | votes shy in the drive to force house consideration of the legislation. The petition on file in the chamber carried 110 signatures. A total of 145 are necessary before the bonus bill fight can be carried to the floor. Representative William Lemke • Rep., S. D., who is leading the j "signature drive” predicted that | within a “few days” the requisite | number of members will have signed I the petition. j It was understood that more | Democrats than Republicans had | signed the petition, which assures a 1 vote on the Lemke bill for payment of the bonus in $2,400,000,000 in I “greenbacks.” The measure is virtually the same as the Patman bill, j which passed the house during the stormy “bonus army” days of the ; seventy-second congress.
