LIQUOR RULES ANNOUNCED BY EXCISE CHIEF Regulations for Sales and Manufacture Given by Fry. (Continued From Page Fifteen) amounts of not less than five <s> gallons may be made by the holder of a wholesale spirituous beverage permit to hospitals, sanitariums, industrial establishments and public Institutions, not holding any permit. for industrial, scientific or external medical use only by such purchaser, upon special permit issued by the excuse director, after application therefor upon forms prescribed by such excise director, which ,said alcohol shall be exempt from the excise tax of twenty-five (25 1 cents a pint. 17. No holder of a wholesale spirituous beverage permit shall own, possess, operate, use or cause to be operated or used in the state of Indiana any still or distilling apparatus for the distillation of any alcohol or spirituous liquor, unless such still or distilling apparatus shall have first been registered with the excise director of the state of Indiana. Application for registration shall be made on forms to be prescribed by the excise director, and when so registered, such still or distilling apparatus shall be assigned in such place as is named in such registration permit. Before such still shall thereafter be destroyed or removed from such place named in such permit, application for such destruction or removal shall be made to the excise director and a permit granted by him for such purpose Druggists to Sell 18. Retail spirituous beverage permits shall be issued only to reputable retail druggists, owning and operating their own establishments and who have so owned and operated the same under a permit issued by the Indiana state board of pharmacy for a period of not less than three years continuously immediately prior to the date of making application for such permit, provided, however, that where such retail pharmacy has been established in the same location for not less than three years, such threeyear ownership requirement may be waived by the excise director in the event of a bona fide sale, transfer or reorganization of such business. 19. Such retail permit'shall authorize the holder thereof to purchase such spirituous beverages and wine tonics as herein defined, from holders of wholesale spirituous beverages permit issued by the excise director after application by such retail permittee and the issuance of a permit to purchase the same, by such director, in accordance with the rules and regulations. 20. Such retail spirituous beverage permit shall authorize the holder thereof to sell such spirituous beverages and wine tonics in the original sealed packages in which the same are received from the wholesaler, and which said package shall have affixed, at the time of such sale, spirituous beverage stamps is ued by the excise director at the rate of twenty-five (25c) cents per pint or fractional part thereof. Sales so Persons 21. The applicant to purchase such spirituous beverages or wine tonics shall be required to present himself in person at the place of business of such retail permit holder for the purpose of purchasing and receiving such spirituous beverages or wine tonics from such retail permit holder. No sales or deliveries shall be made outside the business establishment of such retail permit holder nor shall the same be made to any agent or representative of such purchaser, provided, that this section shall not apply to sales supported by prescription. 22. At the time of making such sale, such retail permit holder shall require the purchaser thereof to execute an application for the purchase of such spirituous beverages or wine tonics, which said application shall be in such form as may be prescribed by the excise director, and shall be signed by such purchaser and witnessed by the representative of such permit holder making such sale. Such application shall be kept by such permit holder for the period of at least one year thereafter and shall be at all times, during business hours, subject to inspection by the excise director or any duly accredited agent or representative of such director. Provided, however, that where such sale is made on written proscription of a duly licensed physician, as herein provided for. such application shall be signed and executed by the person presenting such prescription, and shall have such prescription attached thereto. Limit Sales Amount 23. Such retail permit holder, at the time of such sale, shall attach or cause to be attached to each such original sealed package of spirituous beverages or wine tonics, a label showing the name of the retail permittee. the number of his permit and the date of such sale. 24. Not more than four (4> quarts of such spirituous beverages and (or) wine tonics shall be sold to any one person on the same calendar day. -i * * • 25. spirituous beverages or wine tonics shall be made before the hour of 7 o’clock a m. or after-the hour of 11 o’clock p m., or upon Sundays, or upon the day of holding any primary. general or local election, unless such sale shall be supported by a written prescription issued by n duly licensed physician showing that an emergency exists for the same, and that such spirituous beverages or wine tonics are to be used for medical purposes only. 26. No prescription shall be required for the sale of such spirituous beverages or wine tonics as herein defined, by a retail permit holder on days other than Sundays or the days of holding a primary, general or local election, when such sales are made between the hours of 7 o’clock a. m. and 11 o'clock p. m. 27 No sale shall be made to a minor, a person of unsound mind, or inmate of any charitable, correctionable or penal institution, a person in the habit of using intoxicating liquors to excess, or a person who at. the time of attempted purchase is intoxicated. Nor shall any sale be made to any person, if, at the time of such sale, such permit holder has reason to believe that such purchaser will resell the same. 28. No retail permit holder shall permit any such spirituous beverages or wine tonics to be consumed upon the premises, including the grounds and buildings appurtenant thereto, but the purchaser thereof shall, after such delivery to him, remove the same from the premises, including the grounds and buildings appurtenant thereto, without breaking the seal of such package or packages in which the same are contained. 29. All records required by the excise director to be kept by such retail permit holder, shall be at all times, during business hours, open to the inspection of the excise director or any of his duly accredited agents or representatives.
