But an exception is made in a clause which provides that should the excise director deem it advisable he may, in his discretion, waive such requirements. Last clause of the section sets out that all such sales must conform with national laws. Taken as a whole, it is contended by proponents of the plan for legalization without further legislative action, that Section 24 gives the excise director power to license any place he ‘deems advisable,” without any pharmacy restrictions, j Under other sections, rules, with : the effect of law, can be laid down Ito specify exactly what kind of places these may be, and thus prevent return of the saloon, they declare. The adjustment board has the power, under the $1.50 tax law, to declare an emergency in raising the tax rate above the maximum. No indication has been given of the probable attitude of the board, although it will meet for organization Friday. Holmes declared that if the tax adjustment board refused to reduce the levy substantially, the case would be appealed to the state tax board, the final resort. If demands are passed to the state board by the county board, the probable occurrence, and the state board refuses to accede to reduction demands, a general call will be issued for the strike, Holmes declared.
