EVANS LASHES AT LEGISLATORS IN STATE JOBS More Than 25 Members of Assembly Holding Posts Illegally, Is Claim. More than twenty-five Democrats ! who were members of the house of the Indiana general assembly this year are holding appointive positions under the McNutt administration in violation of the state Con- j stitution, it was charged today by \ Representative Herbert H. Evans of Newcastle. Evans was Republican floor leader during the legislative session. In support of his contention, Evans quotes Section 30, Article 4, of the Constitution, as follows: “No senator or representative shall, during the term for which he may have been elected, be eligible to any office, the election of which is vested in the general assembly, nor shall he be appointed to any civil office of profit which shall have been created or the emoluments of which shall have been increased during such term, but this latter provision shall not be construed to apply to any office elective by the people.” Among legislators listed by Evans who are holding state positions are Frank Finney of Martinsville, head of the license burtau; Albert F. Walsman, Indianapolis, state tax board member; Rollin S. Place, Denver, traveling auditor for the license department; Raymond C. Wickersham, Logansport, and Ray Gilbert, Seymour, in the public service department. "All these departments in which these legislators are employed at fine, fat salaries,” Evans asserts, “were created or re-created and revised in the session of the general assembly in which they served. We also must remember that Senate Bill 130—the ‘ripper bill,’ was intended to set aside the Constitution, and, so far as the present administration is concerned, I think it has been done.” BANKERS •CHASTENED.’ STATE CANNERS TOLD They’ll Be Better in Future, Says Fletcher Trust Vice-President. Bankers have been “chastened” and will be better in the future, the Indiana Canners’ Association was told at their spring meeting at the Claypool, which continued today. The speaker was William B. Schiltges, vice-president of the Fletcher Trust Company. He predicted a “new deal” in banking practices. Governor Paul V. McNutt termed currency inflation “frankly experimental,” and pointed out that it was but a part of the effort of the Roosevelt administration to deal with depression problems in an aggressive manner. ARSON RULING IS GIVEN Convicts Not Eligible to Parole, Lutz Says; Bans Sentence Suspensions. Suspension of sentence and parole of the prisoner is not possible under the Indiana law in cases of arson conviction, Attorney General Philip Lutz Jr., ruled Thursday. Ruling w T as made on request of A1 Feeney, head of the state safety department. Another ruling, given the adjutantgeneral, was that property leased for exclusive use of the Indiana national guard is tax exempt.
