CHAIN STORES' TAX BRANDED BLOW AT POOR Cincinnati Lawyer Defends System, Warns of Harm to Working Man. Passage of the house bill to levy a $l5O annual tax on chain stores with more than twenty establishments would mean adding between $4,000,000 and $5,000,000 to the cost of the poor man's food in Indiana. With thus statement from Robert S. Marx, prominent Cincinnati attorney, in mind, and the counter contention that the independent! retailer represents the democratic : way of American life, the senate finance committee prepared today! to pass on the bill. For nearly three and one-half hours Monday night they had listened to arguments on the subject. The hearing was held in the senate j chamber, with standing room only j on the main floor and the galleries packed. Rooters Are Busy The spectators were divided into cliques, retail grocers cheering their spokesmen, and the chain store employes rooting for their cause. Soft spoken, Marx ignored the gallery and talked to the committee, headed by Senator Ward G. Biddle (Dem., Bloomington). He represented the Kroger Grocery Company, founder of which began with a single store in Cincinnati and still resides there, he said. "We have no quarrel with the independent merchant,” Marx told the senators. "He offers us the keenest competition possible. Through such co-operative organizations as the Regal stores and the IRGA, they procure the same mass purchasing advantages, advertising, standard fronts and layouts that the private chains do. “What we do object to is the admitted stand taken by them here in trying to levy a punitive tax. This measure is not designed to raise revenue for the state, but to punish us. Spend Large Sums Figures were cited to show that Kroger stores spend more than $17,000,000 in Indiana than they take out of the state and that their total tax payments are five times their dividends. “I appeal to you on behalf of the patrons who daily conduct a

referendum on whether they want chain stores,” Marx concluded. “We are willing to pay any tax that is levied equally on all business, but not one purposely designed to punish stores that are handling good food at low' prices during this time of great economic distress.” Independent retailers launched their attack against the chains with J. Eugene Hunsberger. secretary of the Indiana Grocers’ and Meat Dealers’ Association, urging passage of the bill. He charged the chains with failing to carry their fair share of the tax burden and turning the country into a nation of hirelings, rather than independent proprietors. w’ho joined in this viewpoint included Amos Pettigo, Indianapolis; Leo Stofelth, Evansville, and Martin H. Dorman, Ft. Wayne. W. R. Weiterick, a Silver Lake farmer, aided the independent merchants’ cause by contending that the chain stores, by buying “leaders” on a large scale, have wrecked the farmer’s produce market. * L. A. Holt, Perry township assessor, asserted that they were not being assessed on stores in like manner with the independent merchant and should be made to pay the tax increase. Representative Fred Galloway • Dem., Indianapolis), co-author of the bill in the house, made a fiery speech for passage and claimed that he was approached regarding a $5,000 bribe to kill it. He has made similar charges regarding other bills in which he has been interested in the house. P. J. Ryan, an Indianapolis real estate owner, opposed the bill, on the ground that the tax would be taken from the store rent. Chester Jackson of the Standard Grocery Company declared the high levy on chains means “taxing the poor,” and both major and independent dealeres opposed it. Present levy is $25 on all stores above twenty.
