In case a bidder whose bid shall be accented shall not within five (5* davs after notice of the acceptance of his bid periorm his bid bv entering into a written contract with the Board, to perform the work in accordance with the specifications, and within that time secure the performance of his contract bv a surety bond with surety or sureties to the approval of the Board, his certified check or draft and the proceeds thereof shall be and remain the absolute popertv of the Board as linuioated damages agreed upon for such failure. it being impossible to estimate the amount of damage such failure would occasion to the Board.
