GERRYMANDERS WIN IN HIGH COURT RULING Congressional Candidates in Three States Taken Off Anxious Seat. fit! oirarit \cir'paper Alliance WASHINGTON, Oct. 19.—The supreme court has taken congressional candidates In three states off the anxious seat, but the fate* of one candidate, now chairman of the most powerful committee in the house of representatives, still is in 4 doubt. The court, in a 5 to 4 decision, held the Mississippi redistricting law valid, overruling a three-judge federal court. Tins will cause the seven places in that state to be filled in elections by districts, rather than at large. The decision also is expected to rule in Kentucky, where the redistricting act also was held invalid by a three-judge court. In Tennessee, too. it is presumed It will apply, although a mandamus proceeding, revolving about a contest of the validity of that state's law still is before the supreme court. Collier's Fate in Doubt , Although Virginia submitted a brief in the Mississippi case, its nine congressional places will be filled by elect lons-at-large, according to one authority. This authority contends that the Virginia redistricting law was thrown out by that state's supreme court on the grounds that It did not conform with the .Virginia Constitution. It now may be argued that this provision of the Virginia Constitution is invalid, however. In Mississippi as a result of the supreme court decision, the fate of Representative James W. Collier, chairman of the Democratic ways a*nd means committee, is in doubt. After the three-judge court threw out the state’s redistricting law, the governing body of the Democratic party advised candidates for congress to run in their districts. Question Over 1911 I.aw Collier held to the court*decision, and announced he would run at large. Asa result, Representative Russell Ellzey apparently was nominated in Collier’s district, which had been thrown in with part of Elisey's old district, when the state lost one congressional place. Whether Collier will make a demand for the nomination, or offer himself as an independent candidate in his district is not known here. The supreme court decided the ! Mississippi case on the question of I whether or not a stipulation on the reapportionment act of 1911 was ; still force. Th provision made it necessary ! that congressional districts should j be contiguous, compact, and as nearly equal in population as possi- ! ble. , Liberal Judges Dissent Tn the last rcapportionmnnt act this provision was not included, but I4ie old clause was not expressly repealed. The court majority held that .even so, the intent of congress to eliminate it was plain. The four liberal judges dissented. The decision might in effect be* considered a victory for gerrymandering, for under it, and unless congress sets up the old specifications again, congressional districts apparently need not be contiguous, compact or approximately equal in population. However, the court’s decision seems to affect only the states named. Most of the other states already have redistricted.

SCHOOL BUDGET SLASH ORDERED . IN MANY CITIES Reduction in 63 Centers of Population Averages 8.5 Per Cent. By firrippi-Hairard .\>?rtpoprr AllianCr WASHINGTON, Oct. 19.—School systems of the large cities of the country are suffering in the depression, reducing budgets and cutting salaries, a survey by the National Education Association shows. In sixty-three of ninety-three cities of more than 100,000 population, school budgets for 1932-33 have been reduced on an average of 8.5 per cent, the N. E. A. statistics show. In only seven of these cities have school budgets been increased, and those by less than 5 per cent. In three there have been no changes, and in the remainder the reductions range from less than 5 per cent to 20 per cent or more. Os seventy-five cities, only 11, or 14.7 per cent, are operating this season without mou.ncation ofteacher salary schedules.
