RETAIL SALES IN CITY BETTER THAN AVERAGE Business Here 48 Per Cent Above General Run for United States. By Time# fcprcial NEW YORK. June 17.—Retail Rales in Indianapolis are 48 per cent better than the average for the United States, according to a comprehensive analysis of the major retail markets of the nation just completed by Erwin, Wasey &. Cos., international advertising agency, with headquarters in New York and with offices in six leading cities of the country. The analysis, said to be the most thorough and comprehensive of its kind ever made in this country, is based upon the first official census of retail sales made by the United States government in connection with the 1930 census, and has been published in book form by Erwin, Wasey & Cos. In the analysis, the retail sales index gives 100 as the average for the country, with Indianapolis retail sales placed at. 148. Per capita retail sales expenditures in Indianapolis in 1930 amounted to $604. as compared with $379 for the state of Indiana and S4OB for the United States.

Indianapolis was above the national average in retail sales of practically all major products. The figures show that Indianapolis was 45 per cent above average in gro-

Os the big cities of the country, Indianapolis ranked high in retail sales in 1930, with total sales amounting to $220,000,000. New York was first with $4,402,000,000; Chicago second, with $2,153,000,000; and Philadelphia third, with $1,122,000,000. Total sales for the country amounted to $50,030,000,000. Among the states, Indiana ranked twelfth in total retail sales, which amounted to $1,229,000,000 in 1930, or 2.46 per cent of the total retail sales throughout the United States. The survey shows that Indiana ranked eleventh in grocery sales, eleventh in drug store sales, eleventh in department store sales, tenth in automobile sales, tenth in tire and accessory sales, thirteenth in hardware sales and twelfth in sale of household appliances. New York and California vied for first place, with retail sales in both states 41 per cent above average. However, California showed a per capita retail sales expenditure of $576, as compared with $575 for New York. South Carolina was low, with retail sales there placed at 58 per cent below average. MAN FREED IN MURDER, FIGHTS INDIANA TRIAL Hymie Martin, Ex-Lifer, Is Wanted for State Bank Robbery. By United Press CLEVELAND. June 17.—Attorneys for Hymen Hymie) Martin, acquitted of murder charges in his second trial resulting from the death of former Councilman Williaim Potter, planned today to fight attempts to extradite the reputed whisky runner to Indiana on bank robbing charges. He once served eleven months of a life term sentence. Immediately after his acquittal, Martin was arrested on a bench warrant on file here since Feb. 23, 1931, charging that he was identified as one of three men who robbed a Gas City Indiana bank of SIO,OOO Nov. 2, 1928. Martin denied ever visiting the town. Sheriff Bert While of Grant county, Indiana, notified officers here that he would come for Martin as soon as extradition papers could be obtained. William E. Minshall, Martin’s counsel, said he would seek a writ of habeas corpus to free his client. He said he doubted whether Ohio had the legal right to allow extradition of "Hymie” to Indiana since Martin was brought here from Pennsylvania in extradition. Potter was found beaten and shot

City Man Informs Criminal Court That He Is ‘Realty Poor.’ “I can't support my father; you’ll have to send me to the state farm.” This request for imprisonment was made today by Richard Cordell of 2048 North Keystone avenue, before Criminal Judge Frank P. Baker, when Cordell was brought before the judge on a suspended sentence of sixty days on the penal farm for failure to provide for his father,' John E. Cordell, 83. Cordell defended his failure to obey a court order of 1931 to pay $4 a week for his father’s support on the ground that he was ‘‘realty poor.” “I’ve got twenty-one pieces of property, and interest on mortgages, Barrett law and taxes have taken everythnig I’ve had this year. I had to borrow money to pay taxes,” Cordell told the judge. He said there were five other children besides himself, one a minto death in an apartment shortly before he was scheduled to testify in an investigation of notorious city land frauds. The alleged Pittsburgh racketeer, convicted and sentenced to life imprisonment in his first trial, was granted anew trial by the appellate court, on the ground that error was made when the court admitted references to the land fraud investigation to be brought into the trial.

Nixon, publisher of the Wabash Plain Dealer, found guilty of contempt of court for his criticism of appointment of a receiver in a suspended bank, was expected today. Nixon was found guilty on the charge Thursday by Judge W. H. Eichorn and fined SIOO and sentenced to ten days in jail. Judgment on the decision will not be entered until Saturday, when the appeal wil be made. Nine hundred persons thronging the courtroom cheered Nixon as he appeared to hear the verdict. Nixon was cited by Judge Frank O. Switzer, whose appointment of Quinten Carver as receiver of the Wabash County Loan and Trust Company the editor had attacked bitterly.

IMPOUNDS DANK JUDGMENT CASH Judge Blocks Compromise in National City Case. Payment of a compromise judgment to the stockholders of the old defunct National City bank of Indianapolis, which failed in March, 1924, was halted today by Superior Judge Joseph R. Williams of Room 2. Judge Williams granted a temporary restraining order impounding money collected from the bank's directors for the payment of the compromise. The money is held by the Indiana National bank. John H. Spahr, representing a group of stockholders of the bank, seeks by the suit to set aside the compromise judgment and reinstate the original judgment of $860,745 by tha Hancock county cricuit court. Defendants in the restraining order granted today in addition to the Indiana National are: the National City Bank, Frank M. Millikan, John R. Welch, Jesse T. Moorman, Archibald M. Hall, O. Mclntyre, Chester R. Robinson, and James P. Goodrich. The suit alleges that the compromise judgment was illegal.
