FREE MOTHER IN MURDER OF NEWBORN SON Jury Failed to Indict Her: Husband Is Held for Trial. Mrs. Josephine Duck wall Tozier. 25, arrested with her husband. Joseph, 28. following the death of their newly bom son. was discharged Friday by Municipal Judge William H. SheafTer. The husband is held on a first degree murder indictment. Discharge of the mother resulted from failure of a grand jury to return an indictment against her. The baby was born April 13 at 1335 North Alabama street, three days after the marriage of its parents at Noblesville. The following morning its body was found in an ash can in an alley back of 101 East Fourteenth street. Newspapers Give Clew Tozier and his wife were arrested April 15. Newspapers wrapped around the baby’s body afforded the clew. Classified advertisements of rooms for rent had been clipped from the papers. Detectives obtained papers of corresponding dates and called at the addresses, finally locating the couple at the Alabama street address. “We did not want the baby,” a statement attributed to the couple reads. Tozier, the detectives said, admitted choking the baby as soon as it was born. "I planned to get rid of it, whether it was bom dead or alive, boy or girl,” the father is quoted. Worked in Store The mother, formerly Miss Josephine Duckwall, is a graduate of De Pauw university and Tozier attended the University of Illinois. The romance which led to their marriage . started in a downtown department store where both were employes. Hearing of Mrs. Tozier was delayed several times in municipal court, while she was recovering, after birth of the baby. She was without medical attention at the birth. James A. Collins, former criminal court judge, was principal speaker Friday at a division luncheon of the Illinois Bar Association at Danville, 111. Clyde E. Jones, chief justice of the Illinois supreme court, presided.

FOUR. HURT IN POLICE CAR CRASH, IMPROVED Condition of Patrolman Dennis Reported Fair. Condition of three policemen and a newspaper reporter injured Tuesday night when the police emergency car crashed at high speed into a parked auto in the 5000 block. Central avenue, was reported improved today. Patrolman Robert Dennis, most seriously injured, was reported in “fair” condition, while Sergeant Harry Schley, patrolman Thomas Aulls, driver, and Joseph K. Shepard, the reporter, rapidly are recovering from bruises and bone fractures.
