UNWRITTEN LAW PLEA IS READY IN HONOR CASE Mixed-Blood Jurors Hear First Evidence in Honolulu Trial. H„ April 11.—A jury of mixed whites and browns heard first evidence today in the trial of four Americans charged with the honor slaying of Joe Kahahawai, native youth. Clarence Darrow and his battery of assistants were ready for a strong fight to win acquittal. The fact that seven Caucasians sit on the jury with five Orientals and Polynesians complete the defense. Though the shrewd and farsighted Darrow was silent there is no doubt he is well aware of Hawaii’s unusual law which prescribes that when two trials of the same case result in disagreement, the defendants must be freed. At Least Half Victory Hence, a hung: jury would at least be half a victory for the defense in this case, with little prospect that Prosecutor John Kelley would order them tried again. It is costing the territory about S3OO a day to prosecute the case. The defense, it is estimated, will cost $40,000, most of it paid out of a fund raised by navy men here. Massie, and Sailormen E. J. Lord and A. O. Jones are held as “prisoners-at-large” during their trial. The psychiatrists, it was learned, will be used in a plea based on the unwritten law, together with the claim that Kahahawai actually was killed during an emotional collapse by one of the defendants. Dapper, tense Lieutenant Massie will be the star defense witness — possibly the only one—if this stratagem is carried out. No statement has come from the quartet as to what happened last January when Kahahawai—suspected attacker of Mrs. Thalia Fortescue Massie, the officer’s bride—was spirited from the courthouse steps and shot to death. May Tell Conversation A frank admission of all the facts, even to calling some of Prosecutor Kelley's witnesses, probably will be resorted to by the defense. It is expected Massie will tell of a conversation he had with Kahahawai, making an emotional appeal to the jury on the sanctity of his home. CREW CHAMPS RETURN California Oarsmen Drub Huskies in Coast Regatta. By United Press SEATTLE, Wash., April 11.— Coach Ky Ebright and his champion University of California oarsmen neared home today with the laurels they gained from University of Washington in the Pacific coast intercollegiate regatta here Saturday. Badly beaten by the Huskies at Oakland Estuary last year, the Golden Bear varsity performed with matchless precision on Lake Union and won by a full ten lengths. Some 30,000 fans saw the Californians cover the three-mile course in 16:39. The Huskies trailed in 17:49.

FINISHING second to such a notable golf personage as Charles (Chick) Evans can not be regarded as the world’s worst accomplishment exactly, but still we can not figure how the slipping veteran. Mr. Evans, finished eight strokes out in front of our young Indianapolis
star, Billy Heinlein, in a 54-hole t o u rnament at French Licks hills course the last week-end. Os course, scores are convincing, and when the tally sheet reads: Evans, 216; Heinlein, 224, there is nothing left to do but take the results. was two strokes better than Johnny Lehman, former Big Ten conference champion while at Purdue, and later western amateur champion in 1930. Also, two strokes better than Jimmy Manion, St. Louis, who is one of the best, if not the best, among the Mound City mashie duelists. Then, too, Billy was three strokes better than J. Westland, Chicago amateur star, who had 227. Maybe we should not be so critical of our young star during early season play. nun Bill knows the Hills course. Dating back to the days he caddied over it, up to last year when he won the state amateur championship, Bill has had annual playing experience on the Hills links. While the layout is a little tougher in the spring when the gorund is soft in comparison to August, when the hard turf takes the ball fot* a mile ride, that should make little difference to Heilcin, who is a hard and long hitter. tt tt tt It was a great tournament, the first annual midwestern amateur, as It is to be known to the golfing public. According to H. J. Fawcett, manager of the Springs hotel who promoted the event, it will be repeated. With the weather miserable. 136 golfers entered the playing field and that total undoubtedly wilf be increased next year. Mrs. H. R. Raymond of Evanston, ill., won the special two-dav tournament for women held over the lower course. tt u MAX BUELL, one of the four other Indianapolis players to take part in the meet, told us today there were 160 players who came down from Chicago alone, but when Friday, the first day, turned out to be a day of downpours, many of them didn’t enter the tournament. Some played Saturday and Sunday and every one seemed very much enthused over the layout. t tt Buell had an 83 in the rain Friday and Joe Stout, Dr. C. H. McCaskey and Paul Shaffer likewise found trouble getting their scores down to normal, but on Saturday all hit well. Max Buell came home with three birdies on the last three holes for a 73 Saturday. Stout had an 81, and Shaffer, 83. Buell had a 79 and “Doc” smashed out a splendid Tfi, so it was a tired but happy Indianapolis group that trudged into town Sunday night. Buell said Heinlein's 76 on Friday spoiled his chances, because it ruined his morale and he never recovered. I. U. MATMEN TRIUMPH Two More Crimson Wrestlers Qualify for Olympic Trials. By Times Special CHICAGO, April IT. —Two more Indiana U. grapplers were qualified for Olympic trials today, in addition to the seven who won berths in the national collegiate meet last week. H. Devine pinned Jack Spencer of Northwestern in the 134-pound class of the Central A. A. U. Carnival and J. Kechich decisioned R. Notley of Northwestern in the 191pound event. Neither competed in the recent national tourney, being reserves on the Crimson squad. WABASH, PURDUE CLASH By Times Special LAFAYETTE, Ind., April 11.— Purdue diamond pastimers hoped to turn in their second win over Wabash when the rivals tangled here today. Purdue won its opening game of the season Saturday, beating Wabash. 5 to 4. YOUNG URGED FOR COALITION CHIEF OF U. $. Dudley Field Malone Would Bar Only Roosevelt on Slate. By United Press BOSTON, April 11.—Dudley Field Malone, high in the councils of Tammany Hall, has suggested Owen D. Young as the Democratic presidential nominee with a coalition cabinet slate including practically all leading Democratic candidates, except Franklin D. Roosevelt. Malone’s suggestions included Speaker John N. Garner for VicePresident. Malone expressed the hope that the Democratic candidate would announce before the campaign begins “a coalition cabinet of the type which appealed so strongly to the British people and promptly restored their confidence in themselves.” His suggestions for the cabinet and some of his reasons for the individuals proposed were: Secretary of State Newton D. Bake.r, “because of his scholarly statesmanship and his ability to develop a strong American foreign policy.’’ A1 Would Be Treasury Chief Treasury—Alfred E. Smith,“because he is easily the greatest administrator of finance in its relation to politics and government, and because, as head of the treasury, he would put an end to the financial orgy which has been part of our attempt to enforce prohibition.” War —Patrick J. By United Press CHICAGO, April 11.—Daniel Brocato, 28, who said he had been unemployed two years, walked into a police station. He laid a revolver on the table and said he had been planning a robbery, but his conscience wouldn’t let him go through with it. He was locked up on charges of carrying a concealed weapon.
