INFLUENCE OF JURIST IS USED TO BEG VOTES Judge Garvin Pleads With 1,700 Former Jurors to Back Earl Cox. BY BEN STERN Municipal Judge Thomas E. Garvin has signed and mailed 1,700 letters to former jurors in his court, urging that they vote in tne Democratic primary for “my very good friend Earl R. Cox,’’ candidate for the circuit judge nomination. Use of his position on the bench by Garvin to further the political ambitions of a friend openly was criticised today by both Democratic and Republican attorneys and, it was declared the matter may be brought to the attention of the bar association. The letter contains one paragraph in particular of significance to thousands familiar with court and jury procedure. “And as to those jurors who asked to be excused—l wish to observe that I always have found that circumstances beyond their control lorced them to ask this indulgence,” the letter stated. Proud of His Effort Garvin obviously was proud of his letter-writing ability today. He said, with a chuckle of selfappreclation: ’I have received some very nice answers in return; nearly everybody knows Earl.” “What are they saying on the .treet?” he asked. “Is there any adverse comment?” Although it is known Garvin was interested in Cox's candidacy, no such exertion of judicial pressure had been expected. Immediately following the 1930 primary, when Garvin filed suit contesting his defeat for the Democratic probate- bench nomination, Cox was appointed special prosecutor by Judson L. Stark, ex-prose-cutor, to investigate alleged frauds. The Letter, in Part Garvin’s letter, in part, to the jurors follows: “I had the privilege of making your acquaintance when you were called as a juror in municipal court, Room 1, in which court I have the honor to preside as judge. “Although our association was quite brief, you. like many others thus called, have remained in my memory. And it is but the expression of my feelings when I refer to the good and honest men who so willingly give their time and service as jurors, and, for a mere pittance, and invariably at a great sacrifice, have assisted the court in the administration of justice. “And as to those who asked to be excused—l wish to observe that I have always found that circumstances beyond their control forced them to ask this indulgence. Urges Vote for Cox “Not unmindful that our acquaintance may have been of short duration, I nevertheless presume to address you this letter, believing that you have retained a friendly feeling toward me, and that you will give this communication favorable consideration. “Os course I do not know your political affiliations, for we did not discuss this matter, but if you are expecting to vote in the coming Democratic primary election. I would appreciate your consideration of the candidacy of my good friend, Earl R. Cox, candidate for judge of the circuit court of Marion county. “It is my pleasure to personally indorse his candidacy and earnestly recommend him to you, and I would appreciate it greatly if you would speak to your friends aboilt him, and vote for him."
