Fitzhenry was to grant a permanent injunction in federal court here today, permanently restraining district No. 11 of the United Mine Workers of America from interfering with operation of the Somerville No. 2 mine at Somerville in Gibson county, and the Hoosier mine in Dugger in Sullivan county. Attorneys met with Fitzhenry to disccuss terms of the formal court order. In the case of the Frisco mine in Gibson county, and the Dixie Bee mine in Vigo county, Fitzhenry asked that affidavits be forwarded him and that he will rule on the evidence of the affidavits. “There is no one more in sympathy with the trade union movement than this court,’’ asserted Fitzhenry. “Real trade unionism, however, does not consist of bombing, beating, and threatening men who are attempting to make a living. The union movement is being harmed by the members of its ranks who indulge in these acts. The union should weed out its undesirable members.” Fitzhenry, of the Southern Illinois district court, assumed jurisdiction when both Indiana judges, Robert C. Baltzell and Thomas W. Slick, disqualified themselves. HUSBAND LEAVES WIFE WHEN SHE GOES BLIND Tragedy Broke Wedding Pledge, Says Woman, Given Divorce.
