DALE CONVINCED STATE SEAT IN HOUSEJSTOLEN' Muncie Mayor Conducts His Own Probe Into Ball’s •No Contest.’ j By Timet Special WASHINGTON, Jan. 29.—George i Dale, "the fighting mayor of Muncie,” is in Washington, conducting a little investigation of his own into the status of the BallVestal congressional contest. Perhaps it would be more accurate to say that he is inquiring into the non-existence of a BallVestal contest. At least the scrappy little mayor, with his investigation almost completed, is of the very definite opinion that there is no such thing as a I contest of the right of Albert H. Vestal, Republican, to occupy the I seat in congress allotted to the old ; Eight Indiana district, j Particularly, Dale has loaded his guns with ammunition to fire at his arch enemies, State Chairman Earl Peters and Claude Ball, his fellow townsman from Muncie, who was Vestal’s opponent in the 193 Q elections. The official count in the old Eight district gave Vestal the small margin of nine votes over Ball. Dale made the rounds here Thurs- ! day. He interrogated Henry T. Rainey, ; Democratic house leader, who said i he had never heard anything to indicate that Ball ever had seriously prosecuted his claim for the seat. Then he interviewed South Trimble, clerk of the house, and learned that although Ball filed notice of a

Gamer is angry about the BallVestal incident, as was shown when he castigated Indiana Democratic leaders at a luncheon given by Representative Louis Ludlow here about three weeks ago. At the time the contest was allowed to

languish, the Republicans apparently had a majority of one in the house and the speakership was at stake. The eighth Indiana district seat would have been the the deciding factor had not several Republican congressmen died before congress convened.
