N. Y. JURIST IS BOOMED AGAIN FOR U. S. BENCH Nation’s Law Leaders Unite to Urge Cardozo for Supreme Court. By Scrippu-f/oieard .V CKtpaprr A Ui'inee WASHINGTON. Jan. 13.—Justice Benjamin N. Cardozo of the New York state court of appeals, again is being considered for appointment to the United States supreme bench. Two years ago, when the senate refused to confirm the nomination of Judge John J. Parker to a vacancy on the supreme court, Cardozo's names was suggested. At that time the American Institute of Law was meeting in Washington. A group of dean's of law schools memoralized President Hoover to name Cardozo. Several of them made similar suggestions in messages reaching Washington today. C olumbia Dean Speaks Among these were: Dean Young B. Smith of Columbia law school, who said. “In my opinion, no judge in the United States is better qualified to succeed Justice Holmes than Cardozo. “I regard him as one of the outstanding jurists of the country.” Smith said, “and I believe most of the. law teachers of the country would approve his appointment. He. is qualified eminently for the position, is regarded generally as , one of the most distinguished judges in the. United States, and nothing would please me better than to see him named to the supreme court bench.” Cardozo Great Figure Dean Herbert P. Goodrich of the University of Pennsylvania law ' school: “Judge Cardozo is a rare combination of profound learning, high ; idealism, and sound common sense and judgment. He is truly a great figure in legal world. I can not j conceive of a more appropriate j successor to Justice. Holmes.” Dean O. K. McMurray of the school of jurisprudence of the University of California: “Cardozo as a successor to Holmes ! would be a perfect appointment. j The elder jurist’s mantle could fit, j no other shoulders with better grace than those of the great and j wise lover of humanity and justice, who now presides over the New j York court of appeals.” Superb Thinker. Writer Dean Henrv M. Bates of the University of Michigan law school: “Justice Holmes’ place never can be filled. The President could make no better choice for his successor j than Chief Judge Cardozo, a man of the loftiest, character, a thinker and a writer of transcendent power, a lawyer and a judge or pre-emi-nent ability gifted in logic and imagination, and of extraordinary understanding of the nature of law.” Dean Charles E. Clark of the Yale law school: “Yale, in common with other law j schools has long regarded Chief j Judge Cardozo of New York as an j outstanding jurist, and has hoped for his appointment to the United ; States supreme court. “To follow a Holmes is exceedingly difficult, but Judge Cardozo ts pre-eminently the man to be the successor to that great judge.”

PATMAN FLAYS MELLON AGAIN IN COMMITTEE Congressman Invokes Old Law Against Head of Treasury. By I riitrd Prts WASHINGTON, Jan. 13.—Repre- ! sentative Patman (Dem., Tex.), charged before the house judiciary committee today that Secretary of the- Treasury Mellon was actively engaged in private business, contrary to a statute which dates from 1789. Patman made his charge in opening the hearing on his impeachment resolution against the elderly and wealthy cabinet member. Mellon's interests in Soviet. Russia and in commercial enterprises place him in a position of ruling on matters in which he has a direct, personal interest, Patman declared. He read a deposition by Mellon, made in 1928, in which Mellon told of a meeeting with the late James B. Duke, at, which they discussed the merger of Canadian Aluminum interests held by Duke, and the Aluminum Company of America. Defends the Law Patman defended the law under which he is proceeding. He said that though ancient, it had frequently withstood attempts to amend it in favor of leniency. Mellon was represented in the committee room by two attorneys, D D. Shepard and A. W. Gregg, both of Pittsburgh. Both are appearing as personal attorneys for Mellon. Gregg was formerly solicitor for the internal revenue, in charge of the prosecution of tax cases. Mellon was busy urging his tax program on the house ways and means committee on the same floor of the house office building as the hearing began. No Fraud Charged Patman said he was making no charges of “fraud, corruption or malfeasance" at, the present, time, but that, he might, later. Such allegations, he said, are not necessary at present, as the mere holding of any commercial interests is prohibited by law.
