FIRST SKIRMISH SET IN JACKSON MURDER TRIAL Defense Attorneys Will Seek Transfer of Witt and Hamilton. Attorneys in the murder trial of Charles Vernon Witt and Louis A. Hamilton, alleged gun slayers of Lafayette A. Jackson, chain store chief, May 27, are scheduled to stage a pre-trial skirmish at Lebanon Saturday. Ira M. Holmes of Indianapolis and Elza Rogers of Lebanon, counsel for the murder suspects, are to file a motion to have Witt and Hamilton taken to the Boone county jail, pending trial, Jan. 11. Since their transfer from the state reformatory several weeks ago the alleged slayers have been held in Marion county jail. In filing the petition before Circuit Judge John W. Hornaday, Holmes will set out that he and Rogers must hold several conferences with the prisoners prior to their trials, which have been continued several times. Will Charge Third Degree The state, led by Prosecutor Herbert E. Wilson, has elected to try Witt first. This, according to counsel, will take at least two weeks. Holmes, it is known, will plead Hamilton and Witt are victims of mistaken identity and purported confessions were obtained from them by duress and beatings, alleged to have been administered by Indianapolis authorities. Jackson was shot down in his store, headquarters of the Standard Grocery Company, 419 East Washington street, May 27, as he leveled a gun at bandits to protect the funds of his company. When the elderly head of the grocery chain attempted to fight the two bandits who entered the store, he kept a pledge often made, that no bandit would rob him without first overcoming him. Say Both Confessed Hamilton is said to have confessed the crime. His statement, issued by detectives, declared he and Witt entered the store and he ordered Jackson, his son, Chester, and others in the store to raise their hands. Hamilton is alleged to have stated he then was struck by a bullet and he opened fire, but did not know how many shots he fired. He said he was dazed by the bullet and went to his home at Iola, Kan., where he was arrested several days after the crime. Hamilton had been released from the Kansas state penitentiary at Lansing shortly before Jackson was shot and killed. Witt Captured While Hamilton was undergoing a grilling in Kansas and being returned to Indianapolis, Witt was nabbed in a north side rooming house, where police ambushed him. Witt said he met Hamilton shortly before the robbery attempt and fired only one shot in the store, according to detectives. This is the shot which was believed to have

struck Detective Charles Bauer who ran into the store when he heard the shooting. Witt is said to have admitted accompanying Hamilton to Kansas, returning a few days later. The car used in the holdup was stolen at Shelbyville prior to the crime and was found the day following the shooting.
BUILD NEW BUSINESS BLOCK ON EAST SIDE F. C. Tucker Company Constructing 6-Storeroom Building. Construction has been started on a one-story, six-storeroom business building on the southeast corner of Tenth street and Emerson avenue, and will be completed by March 1, the F. C. Tucker Company, Indianapolis, builders, say. A pharmacy will be located in the corner storeroom and a chain store grocery organization is negotiating for a lease on one of the other rooms, Tucker, president of the firm, said. The building will have a nincty-one-foot frontage on Tenth street, and a seventy-two foot frontage on Emerson avenue, and each room will have an individual heating plant. MRS. SARAH APPLE DIES Rites Will Be Held Friday for Pioneer Oaklandon Woman. The oldest charter member of Oaklandon Christian church, Mrs. Sarah M. Apple, 82, died Tuesday at her home in Oaklandon. Mrs. Apple had lived with her daughters, Mrs. Bertha Wilson and Mrs. Lulu Newhouse, in Oaklandon since the death of her husband, William M. Apple, a farmer, ten years ago. Another daughter, Mrs. Hattie Bolander of Sunshine Valley, N. M., survives her. Mrs. Apple was a member of the Oaklandon Rebekah lodge. Services will be held in the Oaklandon Christian church at 1 Friday with burial in the I. O. O. F. cemetery. A dual-control motorcycle has been perfected in Germany for instruction of new riders.

Frank Owens called from 1700 South East street. He had heard a loud explosion, followed by flames lighting up the sky at Singleton avenue and the Belt railroad, he said. When police detachments and fire equipment arrived the building, on Beecher street, between Orleans and Applegate street, was a mass of flames and sparks threatened adjoining factory buildings, and residences. New Year celebrators were assembling with such rapidity that it was with difficulty that firemen brought their hoses into play, police report. But the noise and heat failed to disturb the families of Jessie Hendricks, 718 Beecher street, and his father, William Hendricks, 716 Beecher street. They were roused by police and rushed to safety. There were five in the Jessie Hendricks home and eight in the William Hendricks home. The former had a 3-year-old son, Arvin,
who had to be carried from a sick bed. Jesse Hendricks is an engineer at the Central States Steel Company plant near by. He saw a huge steel derrick there supported by guy wires which threatened to fall on a high tension line. Taking command, he urged volunteers from the crowd to aid in moving it and preventing further catastrophe. The building was a two-story frame structure 150 by 70 feet. It was reported to have belonged to Samuel Rauh, Belt railroad owner, and formerly was occupied by the Rauh Fertilizer Company and the Emerson-Scheuring Tank Company. It has been vacant for some time, and a haven for hobos, neighbors declared. No estimate of loss was given by firemen nor was the origin of the fire determined. The United States uses more quicksilver than any other country.
